Triumphant Motel Owner Slams Carmen Ortiz

 

 

 

” A Tewksbury motel owner who just beat back U.S. Attorney Carmen Ortiz’s three-year bid to seize his business has become the latest critic to accuse the Hub’s top fed of prosecutorial bullying.

“I don’t think she should have the power she has to pull this stuff on people,” Russ Caswell, owner of the Motel Caswell, told the Herald last night after a judge’s ruling in his favor.

The feds first tried to grab Caswell’s property in 2009 under drug seizure laws, citing numerous drug busts at the motel. Caswell’s defense team argued that he was not responsible for what guests did. And his lawyers found there was actually more drug activity at nearby businesses, and theorized the government was going after Caswell, who has no criminal record, because his mortgage-free property is worth more than $1 million.

“It’s bullying by the government. And it’s a huge waste of taxpayer money,” said Caswell, whose father built the motel in 1955. “This has been a huge financial and physical toll. It’s thrown our whole family into turmoil. You work for all your life to pay for something and these people come along and think it’s theirs. It’s just wrong. The average person can’t afford to fight this.” “

 

 

   Ironic that the Federal judge in the Caswell case , Carmen Ortiz , is the same one that has been thrust into the spotlight as the prosecuting attorney in the late Aaron Swartz’s case . Swartz , it should be recalled is the internet pioneer , co-founder of Reddit that was facing up to 35 years in jail and $1 million in fines when he took his own life several weeks ago .

The main criteria for inclusion in the top 10 is the amount of money spent by the taxpayer according to official budget declarations, and then attaining the highest level of doing exactly the opposite of their stated intentions.

#10 – Environmental Protection Agency (EPA) – annual budget $8.5 billion: Their record of ignoring environmental damage and the health effects on humans from major events such as 9/11, the Exxon and Gulf oil spills to the worst case, Fukushima, is unparalleled. Rather than investigate and warn of real dangers, they have gone after farmers for dubious claims of water contamination, while treating milk spills as they should have treated oil spills.  Even worse, the EPA has concluded that there is no law preventing it from doing “research” on Americans. A recent lawsuit over the EPA’s work with airborne pollutants will put this claim to the test in Federal court. Their illegal human experiments could break the Nuremberg Code (source: The Washington Times).

Appeals Court Panel Rules Obama Recess Appointments To Labor Board Are Unconstitutional

 An appointment made by a president of the U.S. under his constitutional powers to fill vacancies when the Senate is not in session subject to later confirmation by the Senate

 

” In an embarrassing setback for President Barack Obama, a federal appeals court panel ruled that he violated the Constitution in making recess appointments last year, a decision that would effectively curtail a president’s ability to bypass the Senate to fill administration vacancies.

A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit said that Obama did not have the power to make three recess appointments last year to the National Labor Relations Board because the Senate was officially in session — and not in recess — at the time. If the decision stands, it could invalidate hundreds of board decisions .

The court said the president could only fill vacancies with the recess appointment procedure if the openings arise when the Senate is in an official recess, which it defined as the break between sessions of Congress.

The ruling also threw into question Obama’s recess appointment of Richard Cordray to head the Consumer Financial Protection Bureau. Cordray’s appointment, also made at the same time, has been challenged in a separate case. “

To be fair, I’ll state at the beginning of this story that I spend a great deal more time than the average boater thinking about the Rules of the Road. In addition to teaching students how to pass the USCG Master’s exams from OUPV (Operator of Uninspected Passenger Vessels)  to 100-Ton in the winter, I spend summers driving fast ferries on regularly scheduled runs in New England, and portions of my spring and fall seasons are devoted to delivering boats. What I see in the classroom and on the water has led me to an inescapable conclusion: Very few boaters have a good, working knowledge of the rules, or how to deal with other vessels in crossing, overtaking, or meeting situations.

 

 

 

The people who know the rules best are, for the most part, professional mariners. Granted, it’s their job, and they’re paid to know the rules. Their livelihood depends upon a firm command of the rules, and if they screw up, they face large fines and possible jail time. The mantle of responsibility that comes with a USCG license is a heavy one, and nobody knows that better than the men and women who drive commercial vessels.

On the recreational side, all bets are off. You pony up enough cash and you’re on the water. You’re required to know absolutely nothing before you get behind the helm and frankly, it shows. Tugboat operators, Coast Guardsmen, and other professional mariners dread the start of the “Silly Season” in New England: Spring, when the covers come off the boats and those boats and their owners swarm the bays and sounds. They (usually) follow the one basic rule that’s jokingly referred to as the “Tonnage Rule,” where the larger vessel has the right of way, no matter the circumstance.

Not all boat owners fall into that category, of course. Some may have taken courses and gotten licensing, or have come from the commercial side. Some may have spent some time looking at the book that most vessels are required to carry on board — the Rules of the Road. Some may have taken Coast Guard Auxiliary classes, or watched videos or computer simulations in a wise attempt to know the rules better and be more responsible. Some may have simply spent enough years on the water to understand the importance of the rules and assimilate them.

Sadly, all those people combined are in the minority. “
