  If you’ve been busy leading a full and rich life and missed this week’s excitement here it is in a nutshell: on the day of her confirmation hearing for the position of secretary of state, Hillary Clinton set up an internet server in her home (purchased under an apparent pseudonym “Eric Hoteham”). Perhaps the domain was even run out of two commercial web hosting firms, instead of the home server: 

  For her entire term at the department she exclusively used this unprotected email server, utilizing at last count about 9 different email addresses for all her Internet communications. These entire addresses end in clintonemail@com, which signaled to anyone reading the message that this was not, sent on a government server.

This tactic allowed her to avoid disclosure of her correspondence to Freedom of Information Act and other document production requests, including Congressional inquiries.

  Can she claim she didn’t know this violated Federal laws and regulations requiring this correspondence be kept where it can be archived and, if required, disclosed? Hardly. All officials are routinely warned about such things. In fact, she ordered our ambassador to Kenya fired for failing to use a government server for his communications.

  In connection with Congressional hearings the department was asked to provide her email correspondence and, so the story goes, they had none, so Hillary had her staff go through her records and late last year provided 50,000 emails, and claimed others might be found in the recipients’ files.

  There is also little doubt, given this functional definition, that e-mail has been covered by the Federal Records Act since its adoption by the federal government during the Clinton administration. As Ian Tuttle correctly notes, the State Department’s own manual has plainly provided, since 1995, that e-mail records must be preserved under the Federal Records Act.”

Internal Cable From Clinton State Department Office Barred Use Of Personal Email

 

 

 

 

 

 

 

” An internal 2011 State Department cable, obtained by Fox News, shows that then-Secretary of State Hillary Clinton’s office told employees not to use personal email for security reasons — while at the same time, Clinton conducted all government business on a private account.

  Sent to diplomatic and consular staff in June 2011, the unclassified cable, bearing Clinton’s electronic signature,  made clear to employees they were expected to “avoid conducting official Department business from your personal e-mail accounts.” The message also said employees should not “auto-forward Department email to personal email accounts which is prohibited by Department policy.” “

 

 

   Not only did Hillary send out a warning to staff against using private email accounts for State Department business but in 2012 the US ambassador to Kenya , Scott Gration , was fired for doing exactly that :

Email Eruption: Hillary Hidden Emails Multiply By Ten

 

 

 

 

”  When Hillary Clinton tweeted yesterday in the midst of her latest scandal “I want the public to see my email,” did she mean all ten hidden accounts, or just hdr22@clintonmail.com, the only account to be outed before that tweet?  Now, thanks to a hacker, who seems not to have done anything illegal but use a piece of software, things have gone, shall we say, a little haywire:

 

  A prominent hacker tells Fox News’ James Rosen that Hillary Clinton appears to have established multiple email addresses for private use.

  Aides to the former secretary of state say she only used one private email while in office — hdr22@clintonemail.com. That domain name has been traced to a private Internet server in Clinton’s hometown of Chappaqua, N.Y. The server was registered in the name of Clinton’s former aide Eric Hothem a week before the Obama administration assumed office.

  Rosen’s hacker source employed a tool called “The Harvester” to search a number of data sources to look for references to the domain name Clintonemail.com. The source says it appears Clinton established multiple email addresses, including hdr@clintonemail.com, hdr18@clintonemail.com, hdr19@clintonemail.com, hdr20@clintonemail.com, and hrd21@clintonemail.com.

  Other email addresses include h.clinton@clintonemail.com, Hillary@clintonemail.com, contact@clintonemail.com, and mau_suit@clintonemail.com.

  It’s not clear whether Clinton used any or all of these email addresses. It’s also unclear whether her aides used them. “

Hillary Clinton Used Personal Email At State Dept., Possibly Breaking Rules

 

 

 

 

 

” Hillary Rodham Clinton exclusively used a personal email account to conduct government business as secretary of state, State Department officials said, and may have violated federal requirements that officials’ correspondence be retained as part of the agency’s record.

  Mrs. Clinton did not have a government email address during her four-year tenure at the State Department. Her aides took no actions to have her personal emails preserved on department servers at the time, as required by the Federal Records Act.

  It was only two months ago, in response to a new State Department effort to comply with federal record-keeping practices, that Mrs. Clinton’s advisers reviewed tens of thousands of pages of her personal emails and decided which ones to turn over to the State Department. All told, 55,000 pages of emails were given to the department. Mrs. Clinton stepped down from the secretary’s post in early 2013.

  Her expansive use of the private account was alarming to current and former National Archives and Records Administration officials and government watchdogs, who called it a serious breach.”

  How could this secretive practice in any way be acceptable in a public official ? We fail to understand how this could be conceived as anything other than a blatant attempt to control what parts of her “official” business are made available for public view .

I can recall no instance in my time at the National Archives when a high-ranking official at an executive branch agency solely used a personal email account for the transaction of government business,” said Mr. Baron, who worked at the agency from 2000 to 2013.

  Regulations from the National Archives and Records Administration at the time required that any emails sent or received from personal accounts be preserved as part of the agency’s records.

  But Mrs. Clinton and her aides failed to do so.

  How many emails were in Mrs. Clinton’s account is not clear, and neither is the process her advisers used to determine which ones related to her work at the State Department before turning them over.”

   No matter how one looks at it , EVERY correspondence of EVERY government official , making allowances for certain matters of national security , are PUBLIC property , generated in the public interest and paid for with public funds and thus are required to be archived and saved for future investigation . 

   How is Hillary’s staff picking and choosing exactly what correspondence the taxpayers , historians , reporters and regulators have access to any different than shredding documents or Nixon’s missing Watergate tapes ? And this woman thinks she deserves to be president . Shame , shame , shame …

   It’s not like Mrs Clinton has a stellar record of forthrightness to fall back on . As a matter of fact her past history belies exactly the opposite what with her being fired from the Watergate investigation , Travelgate , Whitewater , Rose Law firm billing records etc. On the contrary the woman is the picture of obfuscation and secrecy , much like her old boss .

” Scandal: Heavily redacted documents show a military response had been drafted in answer to the Benghazi terrorist attack by a group supporting “an Islamic state” in Libya. It also showed the attack wasn’t inflamed by a video.

  It’s taken Judicial Watch two years to obtain from the most transparent administration in history the 486 pages of documents pertaining to the military response to the Sept. 11, 2012, terrorist attack on our Benghazi diplomatic mission. They confirm what we have said repeatedly, that the Benghazi tale spun by President Obama and former Secretary of State Hillary Clinton was indeed a lie agreed upon.

  Despite heavy redaction, they show that the real “JV team” — a term applied by Obama to the deadly Islamic State — resides in the White House. The papers reveal, for instance, that at one point the military relied on a photo from a Twitter post to determine the status of Ambassador Christopher Stevens, who was killed with Foreign Service Information Management Officer Sean Smith in the first of two attacks.

Benghazi Panel To Query Top Officials

 

 

 

 

” A special House committee looking into the deadly Benghazi, Libya, attacks in 2012 will interview a host of current and former high-ranking Obama administration officials as it speeds the pace of the investigation.

  The panel’s chairman, Rep. Trey Gowdy, R-S.C., said Friday he intends to interview 20 high-ranking officials, including former Defense Secretary Leon Panetta and former CIA director David Petraeus, as well as White House chief of staff Denis McDonough and national security adviser Susan Rice.

  The list also includes former White House press secretary Jay Carney, Army Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff, and former national security adviser Thomas Donilon.”

 

 

 

 

” Gowdy has previously said he will ask former Secretary of State Hillary Rodham Clinton to testify at a public hearing before the 12-member committee. He said Friday that appearance should occur “as soon as possible.” Gowdy said last week he was frustrated at the slow pace of the investigation and was going to “ratchet it up.”

  Gowdy said the interviews with the high-ranking officials will begin as soon as April, after the panel interviews 22 potential witnesses who work for the State Department or have knowledge of the attacks.”

Sharyl Attkisson Sues Administration Over Computer Hacking

 

 

 

 

” Former CBS News correspondent Sharyl Attkisson has sued the Justice Department over the hacking of her computers, officially accusing the Obama administration of illegal surveillance while she was reporting on administration scandals. 

  In a series of legal filings that seek $35 million in damages, Attkisson alleges that three separate computer forensic exams showed that hackers used sophisticated methods to surreptitiously monitor her work between 2011 and 2013. 

” I just think it’s important to send a message that people shouldn’t be victimized and throw up their hands and think there’s nothing they can do and they’re powerless,” Attkisson said in an interview. 

  The department has steadfastly denied any involvement in the hacking, saying in a 2013 statement: “To our knowledge, the Justice Department has never compromised Ms. Attkisson’s computers, or otherwise sought any information from or concerning any telephone, computer, or other media device she may own or use.” “

Law Puts Us All In Same Danger As Eric Garner

 

 

 

 

 

 

   Senator Rand Paul should be commended for sparking the conversation that has erupted over his statement , famously ridiculed by Jon Stewart , that cigarette taxes bear some responsibility for the NYPD killing of Eric Garner over a “crime” so trivial as selling loosies . That the discussion has quickly morphed from a concern about one revenue generating “law” that provided the impetus for Mr Garner’s death to the 300,000 some odd laws and regulations that have resulted in the “overcriminalization” of 70% of the populace .

This is a discussion that , while occupying billions of pixels in the libertarian world , has until now been one that has been arrogantly swept under the rug by the Statist supporters in the main stream media . This debate is long overdue and as the following articles make plain , offer much common ground between the Left and the Right and that common ground leads one inevitably to the libertarian view .

   Thank you Senator Paul and also to you Mr Stewart , however unintentional your help may have been .  

 

 

 

” On the opening day of law school, I always counsel my first-year students never to support a law they are not willing to kill to enforce. Usually they greet this advice with something between skepticism and puzzlement, until I remind them that the police go armed to enforce the will of the state, and if you resist, they might kill you.

  I wish this caution were only theoretical. It isn’t. Whatever your view on the refusal of a New York City grand jury to indict the police officer whose chokehold apparently led to the death of Eric Garner, it’s useful to remember the crime that Garner is alleged to have committed: He was selling individual cigarettes, or loosies, in violation of New York law.

  The obvious racial dynamics of the case — the police officer, Daniel Pantaleo, is white; Garner was black — have sparked understandable outrage. But, at least among libertarians, so has the law that was being enforced. Wrote Nick Gillespie in the Daily Beast, “Clearly something has gone horribly wrong when a man lies dead after being confronted for selling cigarettes to willing buyers.” Republican Senator Rand Paul of Kentucky, appearing on MSNBC, also blamed the statute: “Some politician put a tax of $5.85 on a pack of cigarettes, so they’ve driven cigarettes underground by making them so expensive.”

  The problem is actually broader. It’s not just cigarette tax laws that can lead to the death of those the police seek to arrest. It’s every law. Libertarians argue that we have far too many laws, and the Garner case offers evidence that they’re right. I often tell my students that there will never be a perfect technology of law enforcement, and therefore it is unavoidable that there will be situations where police err on the side of too much violence rather than too little. Better training won’t lead to perfection. But fewer laws would mean fewer opportunities for official violence to get out of hand.

  The legal scholar Douglas Husak, in his excellent 2009 book “ Overcriminalization: The Limits of the Criminal Law,” points out that federal law alone includes more than 3,000 crimes, fewer than half of which found in the Federal Criminal Code. The rest are scattered through other statutes. A citizen who wants to abide by the law has no quick and easy way to find out what the law actually is — a violation of the traditional principle that the state cannot punish without fair notice.

  In addition to these statutes, he writes, an astonishing 300,000 or more federal regulations may be enforceable through criminal punishment in the discretion of an administrative agency. Nobody knows the number for sure.

  Husak cites estimates that more than 70 percent of American adults have committed a crime that could lead to imprisonment. He quotes the legal scholar William Stuntz to the effect that we are moving toward “a world in which the law on the books makes everyone a felon.” Does this seem too dramatic? Husak points to studies suggesting that more than half of young people download music illegally from the Internet. That’s been a federal crime for almost 20 years. These kids, in theory, could all go to prison.”

 

 

 

    This Bloomberg View article by professor Stephen Carter of Yale must be read by all who have come to rue the evolution of the most liberty-minded system of government ever devised by the minds of man into the overwhelming Leviathan State that we , as Americans , face today .

    Professor Somin is joined in his agreement with professor Carter regarding the corrosive affect of “overcriminalization” and the danger that it imposes on the citizenry as a whole at Reason , where Robby Soave writes:

 

 

 

” You know what’s also a cause? Overcriminalization. And that one is on you, supporters of the regulatory super state. When a million things are highly regulated or outright illegal—from cigarettes to sodas of a certain size, unlicensed lemonade stands, raw milk, alcohol (for teens), marijuana, food trucks, taxicab alternatives, and even fishing supplies (in schools)—the unrestrained, often racist police force has a million reasons to pick on people. Punitive cigarette taxes, which disproportionately fall on the backs of the poorest of the poor, contribute to police brutality in the exact same way that the war on drugs does. Liberals readily admit the latter; why is the former any different? “

 

 

 

   And finally we come to the piece written by David Henderson of The Library Of Economics & Liberty who rightfully takes issue with Jon Stewart’s ridicule (see above video) of Rand Paul’s assertion that the cigarette tax played a role in Mr Garner’s death:

 

 

 

” In an otherwise excellent segment on the tragic Eric Garner case, in which some New York cops choked to death a man selling loose cigarettes, Jon Stewart, generally a smart man, either misunderstands or plays to his audience’s ignorance. Either way, it’s worthwhile correcting him because there is a very large point to be made about this case, a point beyond the already large point about police gone wild.

  The specific issue is a claim made by Senator Rand Paul. Here’s what the clip has Senator Paul saying:

  I think there’s something bigger than just the individual circumstances. . . . Some politicians put a tax of $5.85 on a pack of cigarettes. So they’ve driven cigarettes underground by making them so expensive. But then some politician also had to direct the police to say “Hey, we want you arresting people for selling a loose cigarette.”

  Stewart’s response? “What the f**k are you talking about?”

  Paul already said what he was talking about. Jon Stewart simply didn’t want to acknowledge the point. Stewart says correctly that the government can enforce laws without going to such extremes. Sure. It can. But one thing we have to be aware of whenever we advocate a law is that government agents who enforce it will sometimes go to extremes.”

” In her first national TV interview, the mother of Benghazi victim Glen Doherty went “On The Record” to discuss her son’s death and the action she’s taking against the CIA, State Department, and his insurance company.

  Barbara Doherty told Greta Van Susteren that the first time she heard that Glen was in Libya was when she learned that he had died. Barbara said that her daughter broke the news to her.

“ It’s the wrong order,” she said of her son dying before her.

  When asked whether the government gave her any information on the day she learned of Glen’s death, Barbara said, “That day was just filled with crying and tears. If they told me anything, I don’t remember it. It was like that for two or three days […] looking back, you’re in a fog and you’re just told what to do, and you do it.”

  It was “well over a month” before then-FBI Director Robert Mueller called Barbara. She said that he apologized for not calling sooner and said it was because he couldn’t find her contact number.

“ I said, ‘You are the FBI,’ he said, ‘Yes,’” she told Van Susteren. “

Benghazi Bombshell: Clinton State Department Official Reveals Details Of Alleged Document Review

 

 

 

 

 

” As the House Select Committee on Benghazi prepares for its first hearing this week, a former State Department diplomat is coming forward with a startling allegation: Hillary Clinton confidants were part of an operation to “separate” damaging documents before they were turned over to the Accountability Review Board investigating security lapses surrounding the Sept. 11, 2012, terrorist attacks on the U.S. mission in Benghazi, Libya.

  According to former Deputy Assistant Secretary Raymond Maxwell, the after-hours session took place over a weekend in a basement operations-type center at State Department headquarters in Washington, D.C. This is the first time Maxwell has publicly come forward with the story.

At the time, Maxwell was a leader in the State Department’s Bureau of Near Eastern Affairs (NEA), which was charged with collecting emails and documents relevant to the Benghazi probe.

“ I was not invited to that after-hours endeavor, but I heard about it and decided to check it out on a Sunday afternoon,” says Maxwell.

  He didn’t know it then, but Maxwell would ultimately become one of four State Department officials singled out for discipline—he says scapegoated—then later cleared for devastating security lapses leading up to the attacks. Four Americans, including U.S. Ambassador Christopher Stevens, were murdered during the Benghazi attacks.

  Maxwell says the weekend document session was held in the basement of the State Department’s Foggy Bottom headquarters in a room underneath the “jogger’s entrance.” He describes it as a large space, outfitted with computers and big screen monitors, intended for emergency planning, and with small offices on the periphery.

  When he arrived, Maxwell says he observed boxes and stacks of documents. He says a State Department office director, whom Maxwell described as close to Clinton’s top advisers, was there. Though the office director technically worked for him, Maxwell says he wasn’t consulted about her weekend assignment.

“ She told me, ‘Ray, we are to go through these stacks and pull out anything that might put anybody in the [Near Eastern Affairs] front office or the seventh floor in a bad light,’” says Maxwell. He says “seventh floor” was State Department shorthand for then-Secretary of State Clinton and her principal advisors. “

” Hillary Clinton Monday night, Diane Sawyer turned focus to Benghazi and grilled Clinton over the “systemic failure” of security on that fateful night. She asked Clinton whether she should have been more involved instead of delegating on security issues at the Benghazi compound.

  Clinton said there were serious security threats, but that’s true of compounds all around the world, and when Sawyer grilled her on how high a priority Benghazi would be, Clinton said it would place in the top 10, but not the top 5, security concerns to the State Department.

  Sawyer repeatedly pressed Clinton on whether there was anything she could have personally done that would have prevented the attack. Clinton said that the reality is while you can be thoughtful and place people where you need them, “we cannot eliminate every threat, every danger.”

Here Are Some Things I Expect To See As A Natural-Born American Taxpayer.

 

 

 

 

” Dear Rep. Trey Gowdy,

  I probably speak on behalf of many (millions?) of American citizens when I say I am most happy at the US House of Reps. forming a select committee to fully investigate Benghazi.

  However, right from the get-go, I have reservations on what the intended outcome of this committee will be. You see, I don’t trust most folks in Washington, Deceit.

  Will House Speaker John Boehner make a premeditated political show of this thing by reverse engineering it to appear to seek the truth in Benghazi, but actually just produce nothing but Republican-advantageous noise and prosperous backroom deals all during this 2014 election year?

  So, the charter or mission statement and limits of jurisdiction and judicial empowerment of said committee must be disclosed up front to all Americans to see for themselves if the stated mission is to be a noble-full-weight-of–the–law mission or a theatrical-no-one-will-be-punished mission, especially if Boehner and his pals risk being indicted for his involvement in any Benghazi-associated cover-up.

  If we fast forward to the year 2017 and see Barry Soetoro-Obama retiring with a hefty pension, hefty health care package, hefty Security coverage, new Obama Presidential Library, and lucrative speaking engagements instead of rotting in a jail cell for any convicted treasonous involvement with the Benghazi murders, then we will know. And my grandson in the year 2074 will know when he is my age, that this so-called select committee never intended to find the whole truth and never intended from the get-go to punish anyone involved in Benghazi….and America just drifts out to sea as a lawless, immoral disheveled ship of state.

 

  Here are some things I expect to see as a natural-born American taxpayer:

 

 1) You pretty much set up the mission and have free-reign to prosecute like the trained and experienced professional you are; let the cards fall where they may and the convicted get punished per existing laws. Why you? Because you appear to be a Nun among Whores in Washington, Deceit.

 2) Include private citizens who have shown a commitment to pursue this case to a whole-truth-and-consequence conclusion, such as Tom Fitton and Larry Klayman of Judical Watch, Sherriff Joe Arpaio and LT Mike Zullo, the Citizens Committee on Benghazi, Orly Taitz, and other outside professionals.

 3) Set a timetable and move this investigation along expeditiously, say, completed by October 2014 or sooner if possible. If any stonewalling, delays, resistance, lying, boycotts, witness tampering, etc. are detected, swiftly fine or imprison the offenders for contempt or obstruction of justice. “
