Silver’s Law Firm Rakes In Millions From Judges He Controls

 

 

 

 

His law firm, Weitz & Luxenberg, gets its asbestos cases — and paydays — moved more quickly than those of other attorneys, and reaps a fortune from favorable rulings by friendly judges, charge lawyers and tort-reform advocates.

  Silver’s East Village firm handles more than half the cases in a special section of Manhattan Supreme Court called NYCAL (New York City Asbestos Litigation). So dominant is the firm, the court’s Web site refers to cases as “Weitz” or “non-Weitz.

  The chief asbestos judge, Sherry Klein Heitler — also Manhattan’s chief civil judge — has handled dozens of Weitz & Luxenberg cases.

They’ve taken over a section of the courthouse, and the people in charge of the courthouse run it for them,” said a disgusted lawyer who files personal-injury cases in Manhattan. “It pours money into the firm.”

The firm told investigators it hired Silver, who has no experience in asbestos cases, in 2002, because it hoped to “increase the firm’s prestige and perceived power,” according to last week’s federal indictment charging Silver raked in about $4 million in bribes and kickbacks.

  That perceived power has paid off, critics say.

  Last year, at Weitz & Luxenberg’s request, Heitler reversed a 20-year rule barring punitive damages in asbestos cases, paving the way for much bigger jury awards and putting pressure on defendants to settle.

  Another judge, Joan Madden, consolidated unrelated asbestos cases. Joining up to seven plaintiffs has resulted in huge increases in NYCAL jury verdicts — from an average of $7 million to $24 million per plaintiff between 2010 and 2014, data collected by Bates White Economic Consulting show.

  Last year, Weitz & Luxenberg won a record $190 million in a consolidated trial for five mesothelioma victims who worked in different jobs for different employers.

  Of 15 mesothelioma verdicts in the last four years, Silver’s firm won $273.5 million of $313.5 million awarded by NYCAL juries. Law firms usually take a third.

  The average award for a NYCAL asbestos case — nearly $16 million per plaintiff between 2010 and 2014 — is two to three times larger than those in other courts nationwide, Bates White reported last month at an asbestos law conference in New York.”

This week she gave a speech in Saskatoon, which is a town in Saskatchewan, which is a province of Canada. The speech was for the Canadian Imperial Bank of Commerce, which is “under investigation from the United States for helping wealthy Americans offshore money in the bank’s Caribbean accounts to avoid paying federal taxes”. I’m on CIBC’s side on that one: By comparison with other western nations, Americans labor under a regime of ever tighter banking constraints that are a disgrace to a supposedly free people.

  So if she wants to cozy up to foreign banksters (as they say in Britain), you go, girl! Nevertheless:

  Secretary of State Hillary Clinton gave a couple paid speeches in Canada yesterday. She was reportedly accompanied by 65 agents of the United States Secret Service to at least one of the events.

  The agents were presumably on hand to help keep the former first lady safe…

  It’s unclear what part, if any, of the security tab was picked up by Clinton — and what part was paid for by U.S. taxpayers. “

Illinois Says Rule-Breaking Students Must Give Teachers Their Facebook Passwords

 

 

 

 

 

” School districts in Illinois are telling parents that a new law may require school officials to demand the social media passwords of students if they are suspected in cyberbullying cases or are otherwise suspected of breaking school rules.

  The law, which went into effect on January 1, defines cyberbullying and makes harassment on Facebook, Twitter, or via other digital means a violation of the state’s school code, even if the bullying happens outside of school hours.

  A letter sent out to parents in the Triad Community Unit School District #2, a district located just over the Missouri-Illinois line near St. Louis, that was obtained by Motherboard says that school officials can demand students give them their passwords. The full letter is embedded below.

” If your child has an account on a social networking website, e.g., Facebook, Instagram, Twitter, ask.fm, etc., please be aware that State law requires school authorities to notify you that your child may be asked to provide his or her password for these accounts to school officials in certain circumstances,” the letter says.”

  The video from a police dashboard camera shows Bridgeton officers Braheme Days and Roger Worley in a Dec. 30 stop that goes awry, with Days yelling at the passenger, Jerame Reid, “Show me your hands!”

“ If you reach for something, you’re going to be f—- dead!” he yells in the video, as reported by the New York Post. Reid then gets shot.”

 

 

    Decide for yourself , but what we see here in the above video is an “amped up” cop screaming and cursing who immediately shoots the alleged suspect as he steps out of the car with his hands in the air . Another man dead at the hands of the State over a failure to stop at a stop sign .

Cop Records Himself Shooting Man For Running Away

 

 

 

 

 

 

” The Muskogee, Oklahoma Police Department just released the video from a fatal on-duty police shooting Friday. The whole thing was captured by an officer’s body camera, and what it shows is horrifying.

  Officer Chansey McMillin can be seen shooting and killing 21-year-old Terence D. Walker back on January 17th. The only observable reason why he as shot was for running from police who confronted him.

  The video documents what otherwise might have been in dispute, that Officer McMillin fired five shots at Walker when the suspect stopped to pick up an item he dropped while running away.”

 

    While the object that Walker dropped may or may not have been a gun , what we saw in the video was a fleeing suspect stop , bend down to retrieve something , and then continue running away . We did not see the suspect turn towards the officer or make any threatening moves .

” The Center for American Progress, the preeminent liberal think tank in Washington, is poised to exert outsized influence over the 2016 president race and — should Hillary Clinton win it — the policies and agenda of the 45th President of the United States. CAP founder John Podesta is set to run Clinton’s presidential campaign, and current CAP president Neera Tanden is a longtime Clinton confidante and adviser. CAP recently rolled out a major blueprint for combat wage stagnation and inequality that many view as a template for a Clinton economic agenda, and there are surely more major policy statements to come.

Journalism School Dean: The First Amendment Ends At Insulting Mohammed

 

 

 

” Unusual, not because it’s rare to see an American journalist bowing to Islamic sensibilities on depictions of Mohammed but because typically they don’t go so far as to demand legal limits on their own profession. When the New York Times refuses to run a cartoon goofing on Islam, they don’t want the reason to be government censorship. They prefer to be censored by more sympathetic agents, like violent Muslim radicals.

  To be precise here, though, DeWayne Hickham, the dean of Morgan State’s J-school, isn’t demanding a “Mohammed exception” to the First Amendment. He’s demanding an exception for all speech that would make the audience so angry that they might react violently — exactly the sort of slippery slope on censorship that people like you and me worry about when images of Mohammed are suppressed. Actual line from this op-ed, regarding the new cover of Charlie Hebdo: “The once little-known French satirical news weekly crossed the line that separates free speech from toxic talk.”

  The most current issue of Charlie Hebdo again has Mohammed on its cover. This time, he appears crying under a headline that reads: “All is forgiven.” Well, apparently not. Ten people have been killed during protests in Niger, a former French colony. Other anti-French riots have erupted from North Africa to Asia. In reaction to all of this, Pope Francis has said of the magazine, “You cannot make fun of the faith of others.”… “

Sheldon Silver, New York Assembly Speaker, Faces Arrest On Corruption Charges

 

 

 

 

” Federal authorities are expected to arrest Sheldon Silver, the powerful speaker of the New York State Assembly, on corruption charges on Thursday, people with knowledge of the matter said. The case is likely to throw Albany into disarray at the beginning of a new session.

  The investigation that led to the expected charges against Mr. Silver, a Democrat from the Lower East Side of Manhattan who has served as speaker for more than two decades, began after Gov. Andrew M. Cuomo in March abruptly shut down an anticorruption commission he had created in 2013.

  Details of the specific charges to be brought against Mr. Silver were unclear on Wednesday night, but one of the people with knowledge of the matter said they stemmed from payments that Mr. Silver received from a small law firm that specializes in seeking reductions of New York City real estate taxes. The total amount of the payments was unclear, but another person has said they were substantial and were made over several years.

  Mr. Silver failed to list the payments from the firm, Goldberg & Iryami, on his annual financial disclosure filings with the state, as required.”

Gallup: Obama Plummets To Lowest Annual Approval Rating Ever

” With six years down and just two left in which to build a legacy, President Barack Obama has posted his lowest-ever average annual approval rating.

  A Gallup poll finds that Obama, in the one-year period between Jan. 20, 2014, and Monday, posted an approval average of just 42.6 percent.

  During their sixth year in office, Presidents Dwight Eisenhower, Lyndon Johnson, and Richard Nixon showed their lowest approval rating as well, with the sixth-year approval rating of every president since 1945 averaging just 45.5 percent, Politico notes.

  President George W. Bush tapped out the lowest at 37.3 percent, while President Bill Clinton scored an average approval of 63.8 percent, just before the Monica Lewinsky scandal broke, Politico reports. Ronald Reagan, in his sixth year, averaged a 59.9 percent approval rating, Gallup reports.”

 

 

   For comparison Gallup provides us with the annual average approval ratings of all presidents since 1945 . As you can see below , Obama’s averages leave much to be desired .

1,700 Private Jets Descend On Davos For World Economic Forum

 

 

 

 

” Billionaires, world leaders and pop stars are clogging up the skies with their private jets as they descend on the annual World Economic Forum in Davos, Switzerland to liaise over issues such as terrorism, the central banks and growing economic inequality.

  Over the course of this week, approximately 1,700 private jets are expected to fly into the region, resulting airport traffic increasing by 10% which means that landing spots are in short supply.

  The Swiss Armed Forces have even opened up one of their military air bases for the first time to try and accommodate the increase in traffic. For private jet companies like PrivateFly, Netkets and VistaJet, this is by far their busiest time of year. “

An Islamic fanatic killed another quartet of Jews at the Jewish Museum in Brussels last spring, and it was a big story for a couple of days, and then faded away. Over the last decade, the Continent seems to have developed a certain psychological ease with the routine murder of Jews. What remains of Jewish communal life in Europe now takes place behind reinforced doors and barbed wire, and the actual extinction of an entire identity group’s presence is discussed as calmly as the long-range weather. Forty-five per cent of British Jews say Jews have no future in Britain, and 58 per cent says Jews have no future in Europe.

  European leaders like M Hollande insist they’re able to protect the Jewish community – or at least hold the remorseless picking-off of their members to manageable levels. The leader of the continent’s biggest Jewish group is disinclined to take such assurances:

  The US Postal Service plans to sell 56 buildings — so it can lease space more expensively — and the real estate company of the California senator’s husband, Richard Blum, is set to pocket about $1 billion in commissions.

  Blum’s company, CBRE, was selected in March 2011 as the sole real estate agent on sales expected to fetch $19 billion. Most voters didn’t notice that Blum is a member of CBRE’s board and served as chairman from 2001 to 2014.

  This feat of federal spousal support was ignored by the media after Feinstein’s office said the senator, whose wealth is pegged at $70 million, had nothing to do with the USPS decisions.

  When the national debt is $18 trillion, a billion seems like small change.”

  • Chatham County, Georgia: Two deputies were put on leave for “inappropriate actions” after a mentally ill man died in custody. The man’s girlfriend had given the arresting officers his medication and requested that he be taken to the hospital because he was having a bi-polar episode, but he was instead taken to the jail.   • Orlando, Florida: An officer was suspended for eight hours for inadequately searching the area after a car was reported to have been driven into a pond. The body of the driver was found in the car in the pond one month after the first report of the incident.   • Update: New York, New York (First reported 07-13-12): A now-former officer was sentenced to 15.5-23.5 years in prison for fraud, counterfeiting, and conspiring to kill a witness. According to the news report, this sentence will run concurrently with the 12.5-14.5 years he is serving for robbery and drug charges. The officer’s actions were uncovered in an investigation originally opened to look into his ticket-fixing scheme. The investigation uncovered widespread misconduct and corruption in the NYPD, resulting in the indictments of 15 officers and administrative sanctions against “hundreds of others.” http://ow.ly/Hj8NK 
  • New Orleans, Louisiana: An officer was arrested for domestic violence and home invasion. According to the news report, the officer kicked down a door during a domestic argument in the middle of the night.http://ow.ly/Hjags 
  • Miami-Dade, Florida: A police officer was jailed for aggravated assault for shooting at a correctional officer in alleged road rage incident.   • Update: Trumbull, Connecticut (First reported 02-26-14): A now-former officer was sentenced to 2.5 years in prison and 10 years of probation for sexually assaulting a teenage girl in a police youth program. Audio Tapes Reveal How Federal Regulators Shut Down Gun Store Owner’s Bank Accounts

 

 

 

 

” Conversations recorded by a Wisconsin gun store owner provide perhaps the clearest glimpse yet into how the federal government uses regulators to target legal firearm and ammunition sellers.

“ Our hands are tied by it,” a regional manager with Heritage Credit Union told Hawkins Guns owner Mike Schuetz of federal regulations which forced the institution to close Shuetz’s bank accounts in November.

  Recordings of Shuetz’s conversations with the manager and a bank teller, which were published online by the U.S. Consumer Coalition, make it clear that the National Credit Union Administration (NCUA) examined the credit union’s books and forced it to close Shuetz’s account — a move he blames on a Department of Justice initiative called Operation Choke Point.”

 

 

 

 

 

 

” Schuetz’s saga began on Nov. 13, when he says Heritage Credit Union informed him that it would have to close his bank accounts.

“ I received a call from Heritage Credit Union in Hawkins, where I set up my business account for Hawkins Guns. They told me I had to close the account because they do not service companies that deal in guns,” wrote Shuetz on Facebook at the time.”

Firearms Sellers Say They’re Being Choked Off From Payment Processors

” Go to a gun show, and you won’t find many merchants using PayPal.

  You’ll also find few vendors using popular payment processors such as Square, Stripe and Spark Pay.

  That’s because some payment processors explicitly prohibit the use of their systems for online — and some in-store — sales of firearms, ammunition and certain accessories.

  Retailers in the gun industry say they’re being discriminated against.

“ Being shut out from mainstream payment processors makes us feel like we are part of some type of shady business when, in fact, there is more regulation and documentation required for federally licensed firearms dealers than most businesses,” said Trevor Blandford of Terminal Performance Associates in Caroline, Va.

  Blandford, 21, has been working gun shows for his family’s business since he was 14 years old. Recently, his parents named him general manager of Terminal Performance, which is known for its custom-built pistols and rifles and originally finished wraps. He and his family sell their merchandise online and at local trade shows.”

 

     As the State continues to pursue it’s gun control agenda in the most deceitful and underhanded ways , it is refreshing to know that at least one financial institution is not allowing this blatantly unconstitutional move by our “employees” in the Federal government to shut down legal businesses …

 

” With few options, Terminal Performance then turned to Transnational, a payment processor located in Rosemont, Ill., that is not shy in boasting its support for the Second Amendment.

  Although it processes payments for a range of industries, Transnational has capitalized on the trend of payment processors choking firearms merchants from their customer lists.

“ Our decision to provide services within the firearms industry mostly is predicated by the fact that we believe through the obtaining of an [federal firearms license] it’s one of the more heavily regulated processes that has good governance and good oversight,” Jae Haas, President of Transnational told The Daily Signal in a phone interview.

  Having been in the payment processing business for 16 years, Haas said he’s observed a growing trend of banks and payment processors adding firearms dealers to their “prohibited” or “high-risk” lists.”

 

 

Lovers of liberty would do well to try and give Transnational as much of their business as possible .

Breaking Down The Numbers: One Third Of Americans Believe Police Lie Routinely

” Do police officers “routinely lie to serve their own interests?” Thirty-one percent of Americans believe they do, and that number rises to 45 percent among African-Americans, 41 percent among young people and 39 percent among Democrats. Republicans reject that charge three to one (60 to 20 percent).

  Those numbers come from a national poll of Americans just conducted by Reuters and the Ipsos polling organization. (Explore the full results here.) Still, the image of the police is more controversial than the reality.

  Asked whether they approve of the job being done by “your local police department,” nearly three quarters of Americans say they approve. Approval is high among African-Americans (56 percent) as well as whites (77 percent), among Democrats (72 percent) as well as Republicans (84 percent).”
