A COP “STOPS YOU” AT A MUSIC FESTIVAL

” The 4th Amendment of the Constitution prohibits “unreasonable” searches and seizures. That means you are supposed to have a right as a citizen to freely go about your business without being randomly detained or investigated. In order to “stop” you, an officer first has to have a belief that you were engaged in criminal activity.

  There are 3 levels of police “stops”. At each higher level of police encounter, the police officer has to show more justification as to why he stopped you.

  Consensual Encounter – A police encounter where you are not the subject of a police investigation and are free to leave. Officers don’t have to legally justify a consensual encounter because you can leave at any time.

  Detention – A police encounter where you are temporarily stopped while the police investigate you for a crime. Officers must have a “reasonable suspicion” that you were involved in criminal activity to detain you.

  Arrest – Permanently stopped and on your way to jail. An officer must have “Probable Cause” to believe you committed a crime to arrest you.”

Top Ten Reasons Why You Should Not Talk To The Police

 

 

 

 

 

REASON #1: Talking to the police CANNOT help you.

” If the police are talking to you, it’s because they suspect you have committed a crime. If they have detained you, it’s because they already have enough evidence to arrest you and they want to see if you will admit it and thus, give them an even stronger case against you.If they have evidence to arrest you for a crime, they will. If they don’t, they won’t.

  It’s as simple as that.Talking to them or not talking to them won’t make a difference! No one has ever “talked his way out of” an arrest. If the police have enough evidence to arrest, they will. If you deny that you committed the crime, they will not believe you. They already have evidence suggesting that you committed the crime.

  But ask any police officer if because of the eloquence and convincing story of the suspect, they have ever been convinced not to arrest somebody whom they had originally intended to arrest, and they will tell you no. They will tell you that in their experience, no one has ever talked themselves out of getting arrested. Talking to the police cannot help you. It cannot prevent you from getting arrested. It can only hurt.”

 

   As you read the other nine top reasons not to talk to the police remember that the police are allowed to lie to you in the course of doing their “duty” , thus no good can come of you voluntarily speaking with them . The days of the friendly neighborhood beat cop there to “protect and serve” are gone .

   Today’s cops protect each other and serve the State . To them we are all criminals until proven otherwise and they will not be swayed by any amount of your vehement protests to the contrary . Keep your mouth shut .

Woman Sues Allegheny County Over Treatment In Jail

 

 

 

” A Ross woman sued Allegheny County on Monday, claiming that sheriff’s deputies injured her arm and the jail’s former medical provider ignored her complaints, resulting in amputation.

  Amy J. Needham, 35, was arrested by county sheriffs April 2, according to the complaint. Her attorney, Marvin Leibowitz, said she was the subject of a warrant because she missed a preliminary hearing on a charge that was ultimately reduced to disorderly conduct.

  When sheriff’s employees arrived, Ms. Needham said she was using the bathroom, but they broke down the bathroom door, according to the complaint. They shocked her with a Taser, applied arm bars and wrist locks, and put on handcuffs “that were too tight,” the complaint said.”

” A man was arrested in Ohio for having a hidden compartment in a vehicle and could face up to 18 months in prison, even though there was nothing in the compartment.

  Just days before Thanksgiving, 30- year old Norman Gurley was pulled over for speeding, but Ohio State Troopers noticed wires running to the back of the car he was driving.

“ During the search, they noticed some components inside the vehicle that did not appear to be factory,” Lt. Michael Combs told WKYC-TV.

  There were no illegal drugs or weapons in the compartment, but Gurley became the first person arrested under the state’s “hidden compartment” law. “

” In a packed courtroom, 52-year-old Ernie Tertelgte told the judge “I am a living man protected by natural law and I have the right to forage for food when I am hungry… You are trying to create a fictitious, fraudulent action.”

Charged with fishing without a license and resisting the arrest for fishing without a license, Mr. Tertegte says he’s being wrongly prosecuted for trying to feed himself.

Tertelgte, 52 years old, was arrested on Monday and is accused of fishing without a license and then resisting arrest.

He appeared before the judge via video from the Gallatin County Detention Center, and it was standing room only more than a dozen friends and family members filled the small courtroom.
Tertelgte appeared subdued and respectful before the Justice of the Peace during Tuesday’s court session, which went very differently than his court appearance earlier this month, where Tertelgte and Three Forks City Judge Wanda Drusch got into a heated exchange.

Terteltge argued that the court did not have the authority to charge him, citing “natural law.”

He told the judge, “You are trying to create a fictitious, fraudulent action.” He continued, “I am the living man, protected by natural law.”

He then yelled, “Do not tell me to shut up! I am the living, natural man, and my voice will be heard!”

Terteltge then pointed at the flag and said, “That is the Jolly Roger, that thing you call the American flag with the golf fringe around it is the Jolly Roger, and you are acting as one of its privateers!”

 

    Mountain Man Ernie Tertelgte’s stand for natural rights should be supported by us all . We’ll have to wait until January to see how far his natural law defense gets him , but he has a point that should be heard . As a friend of his said :

NYPD Cops Arrest Woman Recording Them, Apparently Stealing Wrong Memory Card (Updated)

 

 

 

” New York City police officers arrested a woman who was video recording them from a public sidewalk as they conducted some type of “vehicle safety checkpoint.”

The officers apparently stole a memory card from a camera, which turned out to be the wrong one, allowing us to view the video.

In the Youtube description, under the headline, “You stole the wrong SD card,” Christina Gonzalez said her boyfriend was also arrested.

We were arrested while filming an NYPD checkpoint on a bridge between a soon to be gentrified Bronx and a quickly gentrifying Harlem. We were charged with OGA, DisCon, and resisting arrest. I was holding a bag of yarn in one hand and a canvas in the other. My partner had food in his hands when he was tackled. Even though their violent actions were unjust, we did not resist. Simultaneous with our “arrests”, the checkpoint was closed down.

We were held for 25 hours.”

” On Wednesday, police arrested five students they say were involved in the fight at Chester High School. Police say even more arrests could be coming.

The video shows a group of students not only throwing punches, but using chairs to attack and beat a 16-year-old boy inside the library of Chester High School. According to police, among the arrested students is 18-year-old Edward Stanley who appears to have recorded the fight on his cell phone and later posted the video on Facebook.”

” Boston.com reports that the three are alleged college students at UMass Dartmouth who were connected to Dzhokhar Tsarnaev and helped him after the fact. Boston Police said “there is not threat to public safety”. CNN reported that the three are accused of “obstruction of justice” and two of them are of Kazakh origin.

According to the Sunday Mirror, a source close to the investigation said: “We have no doubt the brothers were not acting alone. The devices used to detonate the two bombs were highly sophisticated and not the kind of thing people learn from Google.

“They were too advanced. Someone gave the brothers the skills and it is now our job to find out just who they were. Agents think the sleeper cell has up to a dozen members and has been waiting several years for their day to come.” “

West Virginia Teen Returns To School With NRA Shirt, Classmates’ Support

 

 

” A West Virginia teen who was arrested and suspended for wearing a National Rifle Association T-shirt to school returned to class Monday wearing the same shirt that got him into trouble.

Jared Marcum, 14, was joined by about 100 other students across Logan County who wore shirts with a similar gun rights theme in a show of support for free speech.

Ben White, the Charleston lawyer representing the Logan eighth-grader, said the Sons of the Second Amendment, a gun rights group, purchased and distributed the shirts.

Jared, a student at Logan Middle School, was arrested and suspended Thursday after he was pulled from a cafeteria line and told to remove or turn his shirt inside-out an order he refused.

Video evidence in the case, Mr. White said, indicates that the situation in the cafeteria deteriorated when a teacher raised his voice while confronting Jared. Other students jumped up on benches and began chanting Jared’s name. “

 

 

 

 

 

 

 

Boston Bomber Could Have Been Deported After 2009 Arrest

 

 

 

” One of the Chechen terrorists who carried out the Boston Marathon bombings could have been deported years ago after a criminal arrest and/or conviction and the other was granted American citizenship on the 11th anniversary of the worst terrorist attack on U.S. soil.

Tamerlan Tsarnaev, the 26-year-old killed in a wild shootout with police, was a legal U.S. resident who nevertheless could have been removed from the country after a 2009 domestic violence arrest and conviction, according to a Judicial Watch source. That means the Obama administration missed an opportunity to deport Tsarnaev but evidently didn’t feel he represented a big enough threat.

Other reporting confirms Tsarnaev’s arrest for domestic violence but we’re seeking confirmation of a conviction. Nevertheless he would have been subject to removal for the arrest itself.

Musharraf Turns Fugitive As Judge Revokes Bail And Orders Arrest

 

 

” Islamabad – In a scene that could be part of an action movie, ex-president Pervez Musharraf of Pakistan stormed out of the court and into his bullet-proof car, fleeing before security forces were able to seize and arrest him.

 
Musharraf had returned to his homeland after living in exile for five years, both in Dubai and London. He hoped to be allowed to stand for election; yet it turned out to be a bid that failed.

 

Last week, he was charged over his decision to dismiss the country’s judges as he imposed emergency rule in 2007. However, he was granted a temporary bail lasting one week, Today, his luck turned for the worse when the Islamabad High Court refused extending the bail and ordered his immediate arrest instead.”

 

 

 

 

 

 

 

 

 N.Y. Vet Arrested For 30-Round Magazines

” Nathan Haddad, a decorated combat veteran, was arrested earlier this month in New York for possessing unloaded 30-round magazines. Mr. Haddad, who has been recognized by the Army for his selfless acts of generosity to fellow soldiers, was charged with five felony counts of possession of “high-capacity” magazines.

Since 1994, magazines over 10 rounds have been illegal. This month, Gov. Andrew Cuomo signed legislation that makes any ammunition feeding device over 7 rounds illicit in New York. (Click here to read New York’s Radical Gun-Control Law.)

Mr. Haddad, who was medically discharged in 2010 after 12 years of service, was arrested when he was stopped by police on Jan. 6 in LeRay, Ny. Through his brother Michael, Mr. Haddad declined to comment on the cause until after his Feb. 20 conference date to meet with the prosecutor and the judge. “

Boy, Not Making Bombs, Arrested for Having Things Cops Think Could Blow Up (And For Drawings That Spooked a Teacher)

 

 

” The Comic Book Legal Defense Fund is publicizing an interesting little story out of Galloway Township in New Jersey:

When a 16-year-old New Jersey boy doodled in his notebook on Tuesday, December 18, he probably didn’t expect to be arrested by the end of the day. However, when school officials saw the sketches, which they state appeared to be of weapons, and the boy “demonstrated behavior that caused them to be concerned,” the police were called.

 

At no point in time did the boy threaten the school, school officials, or his classmates. He cooperated fully with authorities, and a search of the school itself found nothing dangerous…. “

 

 

Nothing dangerous was found , he cooperated and made no threats , yet …

 

 

” A subsequent search of the boy’s home led to his arrest because they found several electronic parts and chemicals. He was charged with the possession of an explosive device and put in juvenile detention. “

 

 

The boy attends a school that is known for it’s ;

 

 

“engineering and environmental sciences and specializing in hands-on learning”

Sayeth the Police Chief : 

 

“There was no indication he was making a bomb, or using a bomb or detonating a bomb,”

 

 

Sayeth the Principal :

 

“thankful that we had a staff member that (saw something that) caused her some concern, and that she had the sense to report it to school officials. These are things that teachers receive training on all the time.”
