This Is How The Feds Illegally Obtain Evidence Of A Crime And Lie About It In Court

 

 

 

” The president continues to dispatch his National Security Agency (NSA) spies as if he were a law unto himself, and Congress—which is also being spied upon—has done nothing to protect the right to privacy that the Fourth Amendment was written to ensure. Congress has taken an oath to uphold the Constitution, yet it has failed miserably to do so. But the spying is now so entrenched in government that a sinister and largely unnoticed problem lurks beneath the surface.

  NSA documents released by Edward Snowden show that the feds seriously deceived Congress and the courts in an effort to spy upon all of us and to use the gathered materials in criminal prosecutions, even though they told federal judges they would not. Among the more nefarious procedures the feds have engaged in is something called “parallel reconstruction.” This procedure seeks to hide the true and original source of information about a criminal defendant when it was obtained unlawfully.

  Thus, in order to maintain the facade of spying only for domestic intelligence purposes, and to appear faithful to public and secret promises (the FISA court only sits in secret) that any evidence of criminal behavior inadvertently discovered by NSA spies will not be used in criminal prosecutions, and so as to keep the mechanisms of domestic spying hidden from non-FISA federal judges who are more likely to apply normative interpretations of the Fourth Amendment than their FISA court colleagues, the NSA and the DOJ began the process of parallel reconstruction.

  Parallel reconstruction consists largely of the creation of a false beginning—an untrue one—of the acquisition of evidence. This, of course, is criminal. Lawyers and agents for the NSA and DOJ may no more lawfully lie to federal judges and criminal defense attorneys about the true origins of evidence than may a bank robber who testifies in his own defense claiming to have been at Mass at the time of the robbery.

  While parallel reconstruction is deceptive, unlawful and unconstitutional, I suspect it is but the tip of a dangerous iceberg spawned by the unbridled NSA spying that Bush and Obama have given us. When you mix a lack of fidelity to the plain meaning of the Constitution with a legal fiction, and then add in a drumbeat of fear, enforced secrecy, and billions of unaccounted-for taxpayer dollars, you get a dangerous stew of unintended tyrannical consequences.”

  It was “well over a month” before then-FBI Director Robert Mueller called Barbara. She said that he apologized for not calling sooner and said it was because he couldn’t find her contact number.

” Activists on the left are demanding President Obama flex his muscle over the country’s spy agencies.

  The CIA’s admission that a handful of officials spied on Senate staffers is proof that the White House has lost control of the intelligence agencies, critics say. They are also discomforted by the continued support Obama has offered for agency Director John Brennan. 

“ This is not an isolated incident,” said Becky Bond, political director with the progressive group Credo.

“ The fact that these intelligence officials are able to keep their job when major breaches or major assaults on the Constitution are made public — let alone all the things that are happening that we don’t know about — it sets a very dangerous precedent,” she added.

  In recent days, more than 42,000 people have signed Credo’s petition calling for Obama to “fire” Brennan, along with agency officials who knew about the snooping on Congress. The petition also calls for the Justice Department to file criminal charges against people involved in the congressional snooping.

  The spying is just “the latest evidence that America’s shadowy intelligence agencies are out of control,” the group said in its petition. “Yet disturbingly, President Obama is still defending Brennan.”

  The administration’s positions have inflamed civil libertarians on both sides of the aisle. But for liberals who supported Obama based in part on his opposition to the powerful security apparatus of the administration of President George W. Bush, the shift is especially painful. 

“ It looks incredibly hypocritical relative to the promises he made over the campaign, and that’s completely been made transparent,” said Demand Progress executive director David Segal. “

White House Accidentally Exposes Afghanistan CIA Chief’s Identity

 

 

 

 

” The White House inadvertently exposed the name of the CIA’s top spy in Kabul, Afghanistan on Saturday when it gave the press a list of U.S. officials participating in President Barack Obama’s surprise visit to the troops.

  According to The Washington Post, the White House released a new list without the name after their reporter raised questions about whether the inclusion was intended.

  The list was emailed on Saturday night to reporters accompanying the president on the trip, and was then included in a pool report written by Washington Post White House bureau chief Scott Wilson. That report was released to more than 6,000 news organizations before Wilson noticed what he believed to be an error.”

” Jake Tapper of CNN’s “The Lead” had Rep. Trey Gowdy on to talk about the Benghazi investigation try to poke holes in any Benghazi investigation.

  Tapper played video of the former deputy director of the CIA, Michael Morrell, testifying that the CIA did believe that the video could be involved.  He obviously thought that this negated any need for an investigation by Trey Gowdy and the special committee and proceeded to ask Gowdy to comment on the CIA director’s comments.

  Trey Gowdy has a great response. But what he says at the end should shock every American. If its truly this bad, then this investigation is going to bring a lot of people down.”

CIA Official Dies In Apparent Suicide

” A senior CIA official has died in an apparent suicide this week from injuries sustained after jumping off a building in northern Virginia, according to sources close to the CIA.

  CIA spokesman Christopher White confirmed the death and said the incident did not take place at CIA headquarters in McLean, Va.

“ We can confirm that there was an individual fatally injured at a facility where agency work is done,” White told the Washington Free Beacon. “He was rushed to a local area hospital where he subsequently died. Due to privacy reasons and out of respect for the family, we are not releasing additional information at this time.”

  A source close to the agency said the man who died was a middle manager and the incident occurred after the man jumped from the fifth floor a building in Fairfax County.”

Evidence Casts Doubt On Ex-CIA Leaders’ Claims On Benghazi Mortar Attack

 

 

 

 

” If former CIA Director David Petraeus and his ex-deputy Michael Morell are recalled to testify on Benghazi, they can expect hard questions about the mortar attack on the CIA annex which killed two former Navy SEALs.

  Republican Mike Rogers, chairman of the powerful House Intelligence Committee, is weighing whether to recall one or both of those officials over their Benghazi congressional testimony.”

 

 

 

 

” Rogers said the evidence suggests a highly skilled team carried out the mortar strike. Fox News has confirmed five rounds were fired in under a minute, with three hitting the annex roof — a target roughly the size of two convenience stores.

” This was exceptionally good shooting. It was clearly accurate. They adjusted their fire, which is a term a mortar crew might use, so they went a little long and a little short and they fired for effect,” Rogers said. “When you fire for effect and you have three rounds hit exactly where they were intended that ended up taking the lives of our American heroes there, that tells me that they knew exactly what they were doing. So that was either significantly preplanned, or it was a mortar crew that was exceptionally good.”

 

    Spontaneous my a** … Lies , lies and more lies . It took only two ranging shots from these spontaneous amateurs to be able to drop the next three rounds right on the Annex roof ? Sure . And ponder this little fact found near the end of the story :

Senate Staffers Slipped Secret CIA Documents From Agency’s Headquarters

 

 

 

 

” Congressional aides involved in preparing the Senate Intelligence Committee’s unreleased study of the CIA’s secret interrogation and detention program walked out of the spy agency’s fortress-like headquarters with classified documents that the CIA contended they weren’t authorized to have, McClatchy has learned.

  After the CIA confronted the panel in January about the removal of the material last fall, panel staff concluded that the agency had monitored computers they’d been given to use in a high-security research room at the CIA campus in Langley, Va., a McClatchy investigation found.”

” It remained unclear Wednesday if the monitoring, the unauthorized removal of classified material or another matter were the subject of a recent CIA request to the Justice Department for an investigation into alleged malfeasance in connection with the committee’s top-secret study.

  Some committee members regard the monitoring as a possible violation of the law and contend that their oversight powers give them the right to the documents that were removed. On the other hand, the CIA considers the removal as a massive security breach because the agency doesn’t believe that the committee had a right to those particular materials.”

” The New York Times is reporting that the CIA took what Sen. Mark Udall (D-Colo.) called “unprecedented action” against the Senate Intelligence Committee in response to an investigation of the spy agency’s actions following the 9/11 attacks.

  The [Senate Intelligence] committee has spent several years working on a voluminous report about the detention and interrogation program, and according to one official interviewed in recent days, C.I.A. officers went as far as gaining access to computer networks used by the committee to carry out its investigation….

  The specifics of the inspector general’s investigation are unclear. But several officials interviewed in recent days — all of whom insisted on anonymity, citing a continuing inquiry — said it began after the C.I.A. took what Senator Mark Udall, Democrat of Colorado, on Tuesday called an “unprecedented action” against the committee.

   Welcome to the 21st century, which is looking a whole lot like the 20th when it comes to CIA fooling around in places it shouldn’t be. The Times story is short on specifics but includes this gem from Sen. Dianne Feinstein (D-Calif.) who generally has never met a government incursion against civil liberties she doesn’t like.”

    Asked about the tension between the committee and the spy agency it oversees, Ms. Feinstein said,         “Our oversight role will prevail.” “

Drones And Robotic Warfare You Just Can’t Imagine

 

 

 

 

” Drones can essentially conduct perch and stare missions nearly endlessly. The technology is developing even more rapidly than the military can grasp, says the director of MIT’s Humans and Automation Laboratory.

  In just the past two years, it seems as if drones are everywhere in the news. This technology has been around for more than 60 years, but has only recently captured both national and international attention. This is primarily because of the increasing use in the military, but also because of concerns that such technology will be turned on a country’s own citizens.

  The average person thinks of a drone as a flying spy camera, loitering overhead waiting to spot a target and then possibly launching a weapon when that target is labeled as a threat. To be sure, this is indeed one mission of drones, typically of organizations like the CIA.

  However, this is by far the least common mission. The vast majority of military drone missions today are data and image collection. Their ability to provide “situational awareness” to decision makers on the ground is unparalleled in military operations since drones can essentially conduct perch and stare missions nearly endlessly.

  This is why their use and demand from the trenches has been so high – they provide an ability to watch as events unfold, providing some clarity to the fog of war, which is the Achilles Heel for military leaders.

  However, in the very near future, these intelligence surveillance, and reconnaissance (ISR) missions will be dwarfed by other uses of drones in operations inconceivable to most military personnel today.

  They will be used to enhance communications, patrol the skies, intercept incoming ballistic and short range missiles, dog fight with other aircraft in the sky, and deliver supplies. Indeed, currently the US Marine Corps has two robotic helicopters that have moved millions of pounds of goods and have been critical in current drawdown efforts.”

 

 

 

 

 

 

 

 

Climate Change Expert’s Fraud Was ‘Crime Of Massive Proportion,’

Say Feds

 

 

 

” The EPA’s highest-paid employee and a leading expert on climate change deserves to go to prison for at least 30 months for lying to his bosses and saying he was a CIA spy working in Pakistan so he could avoid doing his real job, say federal prosecutors.

  John C. Beale, who pled guilty in September to bilking the government out of nearly $1 million in salary and other benefits  over a decade, will be sentenced in a Washington, D.C., federal court on Wednesday. In a newly filed sentencing memo, prosecutors said that his lies were a “crime of massive proportion” that were “offensive” to those who actually do dangerous work for the CIA.

  Beale’s lawyer, while acknowledging his guilt, has asked for leniency and offered a psychological explanation for the climate expert’s bizarre tales.

“ With the help of his therapist,” wrote attorney John Kern, “Mr. Beale has come to recognize that, beyond the motive of greed, his theft and deception were animated by a highly self-destructive and dysfunctional need to engage in excessively reckless, risky behavior.” Kern also said Beale was driven “to manipulate those around him through the fabrication of grandiose narratives … that are fueled by his insecurities.”

 

 

 

 

 

 

 

THE WHITE HOUSE HAS BEEN LYING ABOUT THAT EX-FBI AGENT MISSING IN IRAN FOR SEVEN YEARS, BOMBSHELL AP REPORT SAYS

 

 

 

 

“ Robert Levinson went missing during a business trip to Kish Island, Iran,” that’s what the White House said as recently as last month about Robert Levinson, the retired FBI agent who went missing in Iran seven years ago.

  In March 2007, Levinson flew to Kish Island, an Iranian resort. Days later after a meeting with an admitted killer, he vanished. For years the U.S. has publicly described him as a private citizen who was traveling on private business. However, an Associated Press investigation reveals that Levinson was working for the CIA. In a breach of the most basic CIA rules, a team of analysts with no authority to run spy operations, paid Levinson to gather information. But even after the White House, FBI and State Department officials learned of Levinson’s CIA ties, the official story remained unchanged. (AP Photo/Levinson Family)

  That was a lie, according to a new bombshell Associated Press report.

  According to the AP investigation, Levinson was actually on a rogue mission sanctioned by CIA operatives that did not have the power to do so. And the agency paid Levinson’s family millions ($2.5 million, to be exact) to thwart a lawsuit about it. The scandal also led to three veteran analysts being forced out of the agency and seven others being disciplined.

In an extraordinary breach of the most basic CIA rules, a team of analysts – with no authority to run spy operations – paid Levinson to gather intelligence from some of the world’s darkest corners. He vanished while investigating the Iranian regime for the U.S. government.”

World Of Spycraft: NSA And CIA Spied In Online Games

 

 

 

 

” Not limiting their activities to the earthly realm, American and British spies have infiltrated the fantasy worlds of World of Warcraft and Second Life, conducting surveillance and scooping up data in the online games played by millions of people across the globe, according to newly disclosed classified documents.

  Fearing that terrorist or criminal networks could use the games to communicate secretly, move money or plot attacks, the documents show, intelligence operatives have entered terrain populated by digital avatars that include elves, gnomes and supermodels.

  The spies have created make-believe characters to snoop and to try to recruit informers, while also collecting data and contents of communications between players, according to the documents, disclosed by the former National Security Agency contractor Edward J. Snowden. Because militants often rely on features common to video games — fake identities, voice and text chats, a way to conduct financial transactions — American and British intelligence agencies worried that they might be operating there, according to the papers.

  GATHERING INTELLIGENCE: U.S. and British intelligence agencies — including the Central Intelligence Agency, Defense intelligence agency and Britain’s Government Communications Headquarters — have operated in virtual worlds and gaming communities to snoop and try to recruit informants.   Online games might seem innocuous, a top-secret 2008 NSA document warned, but they had the potential to be a “target-rich communication network” allowing intelligence suspects “a way to hide in plain sight.” Virtual games “are an opportunity!,” another 2008 NSA document declared.”

 

 

 

 

 

 

 

 

Slowly But Surely Unraveling Benghazi

 

 

 

 

 

” The take-away from this week’s session, so Representative Devin Nunes (R–CA) told Fox’s Megyn Kelly, was that the beleaguered U.S. diplomats and CIA staff in Benghazi were not beyond assistance, as Obama Administration officials would have us believe. Repeatedlymembers of the Administration have stated that there was just not enough time for military assets to come to the aid of U.S. Ambassador Christopher Stevens and his staff in the diplomatic facility, or the contractors and staff in the CIA annex roughly a mile away.

Yet, two factors have emerged, undercutting the Administration’s argument:

  • The diplomatic facility came under attack at 9:00 p.m. on September11,      fighting at the CIA annex erupted between 12:30 a.m. and 2:00 a.m., and      culminated with a mortar barrage at 5:00 a.m. on the 12th. Throughout the      evening and the morning, people all over Benghazi, including other foreign      diplomats, followed the fighting with fascination. No one could possibly know with certainty that this was the end of the battle, though Washington clearly      hoped that it was.
  • Seven CIA security specialists actually did come to the rescue from Tripoli, arriving at the CIA annex just as the mortar attack was erupting at 5:00 a.m. Their trip on a Libyan military C-130H cargo plane had been an exercise in      massive frustration, including three and a half hours spent at the Benghazi      airport, waiting on negotiations with local Libyan militias over safe passage from the airport to the CIA annex. The CIA specialists did finally make it to the annex, to the massive relief of the besieged staff. “

 

 

 

 

 

 

 

 

 

Benghazi Witnesses Testify – CIA Contractors Contradict Official Story

 

 

” Contractors described the cries for help that night by the state department personnel as “almost frantic” as they were pleading for help to save their lives.

   Westmoreland reports that when the CIA team arrived, they found the state department personnel unarmed, not “kitted up,” and in hiding. He also said that the testimony revealed that up to the point when the CIA contractors arrived at the compound, no shots had been fired from the American side of the conflict.

   This contradicts previous statements by the State Department-sponsored Accountability Review Board that stated the Americans inside were armed and had their security kits in use.”

 

    The lies continue to make their way to the surface . Benghazi should be the end of Hillary’s political ambitions but given the best efforts of the media in sweeping her malfeasance in the Benghazi affair under the rug and their desperate desire to see her become our first woman president the public at large will remain blissfully occupied with the doings of the Kardashian tribe and the newest smart phones rather than the corruption of the Obama administration and the State department under Hillary’s shameful “leadership” . 

    The lies and coverup of the Benghazi attacks have always been about preserving political viability , firstly Barack’s for 2012 and secondly Hillary’s in 2016 . The water-carriers in the MSM are not about to abandon all that they have invested in the Democratic party because a few Americans lost their lives to Obama/Clinton incompetence and selfishness . CIA Warily Watches For Threats To U.S. Now That 87 Nations Possess Drones

 

 

 

The age of the drone is here, and U.S. intelligence agencies are warily monitoring their proliferation around the globe.

China uses them to spy on Japan near disputed islands in AsiaTurkey uses them to eyeball Kurdish activity in northern IraqBolivia uses them to spot coca fields in the Andes. Iran reportedly has given them to Syria to monitor opposition rebels.

The U.S., Britain and Israel are the only nations to have fired missiles from remote-controlled drones, but the proliferation of unmanned aerial vehicles has become so prevalent that U.S. intelligence sources and private analysts say it is merely a matter of time before other countries use the technology.

People in Washington like to talk about this as if the supposed American monopoly on drones might end one day. Well, the monopoly ended years ago,” said Peter W. Singer, who heads the Center for 21st Century Security and Intelligence at the Brookings Institution.

Two Out Of Eight In Tripoli Sent To Rescue, Honored For Valor

 

 

 

 

” Masked from public view, two of the U.S. military’s elite special operations commandos have been awarded medals for bravery for a mission that further undercuts the Obama administration’s original story about the Benghazi tragedy.

It said time and distance prevented any commandos outside Libya from reaching a CIA compound under attack. The timeline disclosed that a reinforcement flight 400 miles away in Tripoli contained two “DoD personnel” but did not describe who they were. Later, the official State Department report on Benghazi said they were “two U.S. military personnel” — but provided no other details. It made no mention of special operations forces.

But sources directly familiar with the attack tell The Washington Times that a unit of eight special operators — mostly Delta Force and Green Beret members — were in Tripoli the night of the attack, on a counterterrorism mission that involved capturing weapons and wanted terrorists from the streets and helping train Libyan forces.

The two special operations forces arrived in time to engage in the final, ferocious firefight between the terrorists and Americans holed up in the CIA annex near the ill-fated diplomatic mission in Benghazi, the sources added.

The two special operators were awarded medals for valor for helping repel a complex attack that killed Ambassador J. Christopher Stephens, another American diplomat and two former Navy SEALs, but spared many more potential casualties.”

American troops assisted by F.B.I. and C.I.A. agents seized a suspected leader of Al Qaeda on the streets of Tripoli, Libya, while Navy SEALs raided the seaside villa of a militant leader in a predawn firefight on the coast of Somalia.

In Tripoli, American forces captured a Libyan militant who had been indicted in 2000 for his role in the 1998 bombings of the United States embassies in Kenya and Tanzania. The militant, born Nazih Abdul-Hamed al-Ruqai and known by his nom de guerre, Abu Anas al-Liby, had a $5 million bounty on his head; his capture at dawn ended a 15-year manhunt.

In Somalia, the Navy SEAL team emerged before sunrise from the Indian Ocean and exchanged gunfire with militants at the home of a senior leader of the Shabab, the Somali militant group. The raid was planned more than a week ago, officials said, after a massacre by the Shabab at a Nairobi shopping mall that killed more than 60 people two weeks ago.

The SEAL team was forced to withdraw before it could confirm that it had killed the Shabab leader, a senior American security official said. Officials declined to identify the target. “

Google Asks Intelligence Court To Let It Release Data

 

 

” Google Inc. (GOOG) urged the Foreign Intelligence Surveillance Court for permission to publish the aggregate numbers and scope of national security requests it receives from the U.S. government.

The filing with the secret court, which issues warrants for collecting foreign intelligence inside the U.S., is the latest effort by Google to ease restrictions on disclosing the information the government has asked for under the surveillance program code-named Prism.

“We have long pushed for transparency so users can better understand the extent to which governments request their data — and Google was the first company to release numbers for National Security Letters,” Niki Fenwick, a spokeswoman for Google in Washington, said in an e-mail. To promote greater transparency, the company is seeking “to publish aggregate numbers of national security requests, including FISA disclosures, separately,” she said.”

 

Google is late to the party .

 

” Yahoo! Inc. (YHOO), yesterday became the latest technology company to give details of government data collection, following disclosures by Apple Inc. (AAPL), Facebook Inc. and Microsoft Corp., all of whom have revealed thousands of warrants for data from government entities.

Yahoo!, the largest U.S. Web portal, said it got as many as 13,000 requests for information from U.S. law enforcement agencies in the six months ending in May, with the most common types related to fraud, homicides and criminal investigations, Yahoo said in a posting on Tumblr. The Sunnyvale, California-based company said it can’t lawfully break out FISA requests, and it urged the U.S. government to reconsider its stance on the issue.”
