Colorado Sheriffs’ Lawsuit Forces Changes to Gun Control Laws

 

 

” There are plenty of problems with the magazine ban enacted by the Colorado legislature, so much so that two of the Democrats who spearheaded the effort are now facing recall elections. But two of the worst provisions have now been de-fanged thanks to a lawsuit (Cooke et al. v. Hickenlooper) brought by 55 elected sheriffs against Governor Hickenlooper . . .

The two provisions in question go a long way toward illustrating how little that people who write gun control laws know about how guns actually work.

The first was a provision that any magazine that can be “readily converted” to a “high capacity” magazine is banned from sale, which would have banned every magazine with a removable baseplate. On April 4th, Governor Hickenlooper had this to say about that aspect of the new law:

Well there are certain magazines that are actually…uh…designed and have uh…uh…specific holes and attachments to be…to be extended and those specific magazines…uh…where there’s…uh…a…certain level of design specifically just for extension rather than just cleaning. Magpul Offers Soon-To-Be Illegal Weaponry To Colo. Gun Buyers

 

 

 

Colorado gun owners stocking up on magazines before the state’s ammunition restrictions hit July 1 received an assist Monday from Magpul Industries.

Magpul announced that it would reserve a number of 40-round magazines for Colorado residents as part of its Boulder Airlift Program in response to the state legislature’s recently enacted firearms restrictions.

“Also, to beat the July 1st deadline for ownership in Colorado, a small portion of the first batch of PMAG 40s will be available from the Boulder Airlift Program for direct sale to CO residents, regardless of previous orders,” said Magpul in a Facebook post.

Democratic Gov. John Hickenlooper signed into law in March three gun-control bills, including one that makes it illegal to buy or sell ammunition magazines that exceed 15 rounds or can be readily converted to hold more than 15 rounds.

At the same time, the bill allows gun owners who purchase their magazines before July 1 to keep them, a caveat that critics have said will make the law essentially unenforceable.”

 

 

 

 

 

 

Colorado Lawmakers – Secret Service Must Arrest Local Sheriffs For Failing To Enforce An Unenforceable Law

” The furor over the signing into law of Senate Bill 13-013 earlier this week by Colorado Governor John Hickenlooper went viral following the publishing ofan article by Mike Opelka at theblaze.com.  Opelka suggested that the new law could be “used to arrest or force county sheriffs to enforce the state’s new gun laws,” whether they wanted to or not.

It was fanned into white heat when World News Daily quoted Colorado State Representative Lori Saine who exclaimed:

 This is insane! In theory if a Secret Service agent is in a county where the sheriff has refused to enforce some of the recent unenforceable gun laws, the agent could [ignore the sheriff entirely and] arrest any individual if he believes the law has been broken…

I believe it is intended to be used for setting up a framework so that at some other time they could expand it to possibly include being able to arrest a sheriff who is refusing to enforce unconstitutional laws.

Charley Barnes, writing at K99.com in Denver, further fanned the controversy last Monday when he wrote:

By the sounds of it, Colorado is being targeted with an attempt to set up loopholes that will allow the U.S. Secret Service to arrest and remove an elected sheriff for refusing to enforce the law, or anyone [else] breaking the law.”

 

Another Gun Manufacturer Announces It’s Leaving Colorado

 

 

” The CEO’s no-brainer statement, which liberals will find indecipherable and eeeeevil:” HiViz Shooting Systems intends to leave Colorado in the wake of new state gun control legislation signed into law last month, according to the Northern Colorado Business Report.

The Fort Collins company, which makes sights, recoil pads and other accessories, started in 1996. But like Magpul Industries Inc. of Boulder County, HiViz said it’s not happy with the gun control measures approved by the Colorado Legislature and signed into law by Gov. John Hickenlooper. Magpul Industries announced last month it will be leaving Colorado.

“I make this announcement with mixed emotions,” Phillip Howe, president and CEO of HiViz, said in a statement. “Colorado is a beautiful state with great people, but we cannot in clear conscience support with our taxes a state that has proven through recent legislation a willingness to infringe upon the constitutional rights of our customer base.” “

 

 

 

REPUBLICANS MUST FORCE DEMOCRATS TO OWN GUN CONTROL

 

 

 

 

 

” Guns will be the key issue in 2014, good news for the pro-2nd Amendment Republican Party, which has Democrats backed into a corner in an untenable position on gun control.

Universal background checks are insidious, and the legislation the Senate is considering in April will not only force even secondary gun sales to be done through the auspices of a government representative with a Federal Firearm Licence but will also ban private gun sales and create a national gun registry.

This means it will bar grandpas from passing their favorite rifle to their grandsons and will require the government to create a list of every gun owner and every gun owned in America in order to be enforceable.

Universal background check legislation has made it this deep into the legislative process for one reason only–namely, because these implications have not been explained to the American people. Republicans need to explain these dangers and force Democrats to own gun control in 2014.”

 

 

 

CO Governor Signs Sweeping Gun Control Bills Into Law

 

 

 

 

” According to NBC News, Colorado Governor John Hickenlooper has signed into law two gun control bills.

The measures also met resistance from magazine-maker Magpul Industries, which said that it would desert its plant about 30 miles from Denver if the proposed magazine limits became law.

Legislators who had opposed new laws restricting gun ownership said on Wednesday the new gun bills may have electoral consequences for state Democrats.

“We’re all in shock here,” state Senator Greg Brophy, a Republican, said on Wednesday. “It turns out this guy who everybody thought was a moderate Democrat is actually a gun-control governor.”

“I think the governor will be replaced by someone who has Colorado values instead of New York City values,” Brophy said. “If Republicans are returned to control we will repeal these bills immediately.”

” Apparently Gov Hickenlooper has announced that he will sign HB 1224 on Wednesday. We
were asked for our reaction, and here is what we said:

  We have said all along that based on the legal problems and uncertainties in the bill, as well
as general principle, we will have no choice but to leave if the Governor signs this into law.

  We will start our transition out of the state almost immediately, and we will prioritize moving magazine manufacturing operations
first. We expect the first PMAGs to be made outside CO within 30 days of the signing, with the rest to follow in phases. “

Feinstein: Veterans May Have PTSD And Should Not Be Exempt From Assault Weapons Ban

” SEN. DIANNE FEINSTEIN: If I understand this, this adds an exemption of retired military. As I understand our bill, no issue has arose in this regard during the 10 years the expired ban was in effect and what we did in the other bill was exempt possession by the United States or a department or agency of the United States. So that included active military.

The problem with expanding this is that, you know, with the advent of PTSD, which I think is a new phenomenon as a product of the Iraq War, it’s not clear how the seller or transferrer of a firearm covered by this bill would verify that an individual was a member, or a veteran, and that there was no impairment of that individual with respect to having a weapon like this.”

During Friday’s marathon gun control hearing in the Colorado Senate, Republican Sen. Kent Lambert offered an amendment to exempt active military members, veterans and their families from the gun magazine ban.

Enter Sen. Mary Hodge, a disgraceful Dem who urged fellow lawmakers to oppose the exemption because “some of them come back with significant mental health problems.”

House Approves Lowering Tuition For Colorado Illegal Immigrant Students, Bill Goes To Governor

 

 

 

 

” A bill allowing lower tuition rates for illegal immigrant students received final approval from state House lawmakers Friday.

The bill passed 40-21 and will now proceed to Gov. John Hickenlooper, who is expected to sign the bill. Three Republicans joined with all the Democratic lawmakers to approve the bill.

Hickenlooper tweeted, “Undocumented kids will now have a fair and equitable way to pursue a higher education in CO. Well done.”

The bill allows students who graduate from Colorado high schools to attend college at the in-state rate regardless of their immigration status.

Currently, students in the country illegally must pay the non-resident tuition rate, which can be more than three times higher than the in-state rate.”

 

    Colorado has gone insane . Law-breakers are rewarded with lower tuition rates than American students from out of state … This is truly nuts . Tuition breaks for illegals while denying Constitutional rights to citizen gun owners . What is in the water out there ?

    After coming upon the above graphic it has become apparent that many states provide this price break in tuition prices to ILLEGAL ALIENS … At taxpayer expense of course . Remind us again who the politicians work for .

Colorado Dems Seek To Ban State’s Most Widely Used Hunting Shotgun…

Gov. Rick Perry Backs Teachers Packing Heat

 

 

” Compounding a mild pro-gun rant with a declaration to consider a 2016 presidential run, Texas Governor Rick Perry affirmed his commitment to the Second Amendment by encouraging allowing all teachers in the state to carry guns on campus at a Tea Party event Monday.

Perry’s pro-gun remarks arrive amid a heated national gun control debate in which governors across the country are either defending the Second Amendment or taking steps to destroy it.

A Senate bill (S.B. 59) passed by the Michigan house would allow citizens to carry firearms into “pistol free” zones; it awaits Gov. Rick Snyder’s signature.

New Mexico Gov. Susana Martinez told the Albuquerque Journal the state should “consider legislation to keep guns out of the hands of the mentally ill” before considering more drastic action.

Some legislators are geniunely confused about the entire situation and don’t know where to put the blame.

Arizona governor Jan Brewer, whose state weathered heavy Second Amendment attacks following last year’s Tucson shooting, says the answer may lie inevaluating behavioral health services, not in gun control, while Colorado Gov. John Hickenlooper pointed to video games and a “culture of violence” as the main contributing factors in these types of attacks.

“There might well be some direct connection between people who have some mental instability and when they go over the edge – they transport themselves, they become part of one of those video games,” Hickelooper told CNN’s State of the Union.”
