” An agency at the center of NewsChannel 5’s “Policing for Profit” investigation has severely restricted the use of civil forfeiture laws that had been used to seize cash from drivers passing through Tennessee.

  Instead, the new boss of the 23rd Judicial District Drug Task Force said he wants officers to re-emphasize their primary mission of looking for drugs.

  For more than three years, NewsChannel 5 Investigates has shined the light on laws that let police take cash from drivers without charging them with a crime.

  Critics called it “highway robbery.”

I don’t want the public to believe that we are out there trying to just take money from innocent people,” said District Attorney General Ray Crouch. “That is not what we are going to do. I am not going to be part of that.

  It marks the first time that a Tennessee district attorney has publicly rejected the broad use of the civil forfeiture laws that have drawn national attention. For the past several years, the Tennessee District Attorneys General Conference has lobbied lawmakers to preserve that source of money.

” I want the public to know that they do not have to be in fear of the 23rd Judicial Drug Task Force seizing their personal property, their cash, their assets,” Crouch toldNewsChannel 5 Investigates. “

Beretta USA Announces Decision To Move Its Entire Maryland Manufacturing Capabilities To Tennessee

” Beretta U.S.A. Corp., located in Accokeek, Maryland, announced today that it has decided to move its manufacturing capabilities from its existing location to a new production facility that it is building in Gallatin, Tennessee.  The Gallatin facility is scheduled to be opened in mid-2015.  Beretta U.S.A. had previously planned to use the new Gallatin, Tennessee facility for new machinery and production of new products only.

“ During the legislative session in Maryland that resulted in passage of the Firearm Safety Act of 2013, the version of the statute that passed the Maryland Senate would have prohibited Beretta U.S.A. from being able to manufacture, store or even import into the State products that we sell to customers throughout the United States and around the world.  While we were able in the Maryland House of Delegates to reverse some of those obstructive provisions, the possibility that such restrictions might be reinstated in the future leaves us very worried about the wisdom of maintaining a firearm manufacturing factory in the State,” stated Jeff Cooper, General Manager for Beretta U.S.A. Corp.

“ While we had originally planned to use the Tennessee facility for new equipment and for production of new product lines only, we have decided that it is more prudent from the point of view of our future welfare to move the Maryland production lines in their entirety to the new Tennessee facility,” Cooper added. “

” The Italian company had disclosed a $45 million plan this year to expand operations to a new factory near Nashville. But Beretta has decided to go beyond that plan because, a senior executive said, the company is “very worried about the wisdom of maintaining a firearm manufacturing factory” in Maryland.

  Maryland’s new gun restrictions, pushed by Gov. Martin O’Malley (D) after the Sandy Hook Elementary School shooting in Newtown, Conn., bans 45 types of assault rifles and put in place tough fingerprint, photo identification and training requirements. Magazines are limited to 10 rounds.

  A version of the legislation that passed the state Senate “would have prohibited Beretta ­USA from being able to manufacture, store or even import into the State products that we sell to customers throughout the United States and around the world,” the company said.

  Jeff Reh, a spokesman for Beretta USA, said in an interview that executives had become increasingly worried that future legislative sessions could end more “disastrously” for the company. “We wanted to control our own destiny,” he said. “

 

 

     It never ceases to amaze us that the politicians always seem to believe that they operate in a vacuum , that there is no alternative save to do as they command , even while the market continues to demonstrate endlessly that foolish , naive , “feel good” legislation comes with a price tag … that of lost jobs , lost revenue and lost taxes . ” It’s getting pretty hard to kill a death row inmate these days. Faced with a nationwide shortage of lethal injection drugs, states have been scrambling to figure out how to keep executing prisoners without creating more controversy about their methods of capital punishment. Tennessee believes it has found a great solution: Bring back Ole’ Sparky.

  On Thursday night, Republican Governor Bill Haslam signed a bill into law that allows the state to electrocute inmates if prison officials can’t get their hands on lethal injection drugs. The move made Tennessee the first state to bring back the electric chair without offering death row prisoners another option for execution. “I think the legislature felt very strongly we needed to have some sort of backup in case the drugs for the lethal injection weren’t available,” Haslam said on Friday.”

 

 

 

 

 

 

 

” The law, which was overwhelmingly passed by state lawmakers, comes amid mounting questions about the humanity and effectiveness of lethal injection, the preferred method of execution for all 32 states that still use capital punishment. But the drought of lethal injection drugs has forced state officials to experiment with untested lethal cocktails obtained through shady, back-alley transactions. The results are often disastrous, as we saw with the botched execution of Clayton Lockett in Oklahoma last month.”

Jail Inmate Pepper Sprayed While Fully Secured In Restraint Chair

” On December 9, 2013 an inmate was brought to the Rutherford County (TN) Sheriff’s Office jail facility on a charge of “Resisting” and “Hold – Other Department”. The inmate was placed into a restraint chair in the sally port, which binds your wrists and ankles into restraints, as well as various straps to limit movement.

  Upon being brought into Holding Cell #133, a strap that goes across the inmate’s legs to keep movement limited came loose. According to department records, this strap had been malfunctioning for several months prior.

  Deputy James Vanderveer, who was re-hired after being forced to resign due to a DUI arrest, and is the nephew of Sheriff Robert Arnold, enters the holding cell and begins to re-secure the strap. The inmate’s ankles and wrists are still securely in their restraints and he is unable to move his legs or arms more than an inch or two. There appears to be no struggle taking place when Deputy Vanderveer sprays pepper spray into the gap in his spit shield. The spit shield remains in place for ten minutes before being removed.
For one hour and fifteen minutes, the inmate receives no medical attention and can be seen convulsing, yelling for help, and struggling. 

  Deputy Vanderveer stated in a subsequent incident report that the inmate was combative and that his legs had come lose, which is contradictory to video evidence. Jail supervisors later documented that they informed him that “he better write a good report and … hoped he could justify spraying someone while they were restrained in a restraint chair.” Deputy Vanderveer later received a written reprimand for “Disproportionate Use of Force” and is still employed as a sheriff’s deputy.

Former Deputy Accused Of Rape Out On Bond

” No one answered at Willie Greer’s East Ridge residence Friday. Someone peered out the windows, but didn’t come to the door. The 33-year-old former Hamilton County Sheriff’s deputy was out on $50,000 bond Friday.

  Greer is charged with aggravated rape and official misconduct after allegedly forcing a woman to perform a sex act during a traffic stop. He was fired from his job and immediately taken to jail Thursday.

  According to the probable cause affidavit, the 32-year-old female victim was driving down Birchwood Pike in Harrison on January 5th around 1 a.m. when Greer pulled her over for speeding.

  The victim told investigators Greer handcuffed her and said she was going to jail, but kept telling her, “I could let you go, but you’d owe me.” 

  Greer then uncuffed the victim, and had her follow him to a remote area around the corner to “talk about it.” The victim told police the deputy handcuffed her again and then forced her to perform a sex act.”

“He Has No Drugs & Knows His Rights” Cop From Viral DUI Video Wins Controversial Award

 

 

 

 

 

 

” Over the Summer BenSwann.com reported on a viral video from a DUI checkpoint in Rutherford County, TN. The video featured Chris Kalbaugh, a Rutherford County citizen, filming his encounter with police at the checkpoint. His encounter has been viewed more than 4.3 million times on Youtube alone. Controversy swirled as viewers felt the cop was violating Kalbaugh’s constitutional rights. Deputy Ross, from the video, has just won the “Deputy of the Year” award from the Tennessee Governor’s Highway Safety Office (GHSO). The department is responsible for funding DUI checkpoints.

  Ross has worked for the Sheriff’s department twice. He resigned after lying to police about having insurance after being in a car accident. A few years later, under a new sheriff, Ross was reinstated.

Memphis Homeowner Shoots Burglar While Waiting For Police

” A Memphis homeowner who came face to face with two suspected burglars during a home invasion last week put one in the hospital and sent the other fleeing, WREG reports.

  Police said the homeowner called 911 when he heard someone smashing the glass of a back room window, but before officers could arrive, the two suspects were already inside the home. However, little did the suspects know that the man was not only home, but armed as well.

  The homeowner shot at the intruders, hitting one, who was later found about a block away. The suspect was taken to a local hospital where he remains in critical condition.”

  Web developer Evan Booth of Greensboro, North Carolina moonlights as a ‘security expert’ and can make projectile weapons with things like hairdryers and Axe body spray–all of which you can get after you make it through security.

  While he has an airport crossbow, blowgun, and spiked club, it’s Booth’s hand-built gun–which he calls his BLUNDERBUSiness Class–that seems most worrisome.”

School Thug Arrests Dad For Not Allowing His Children To Walk Home Unattended

 

 

    This Tennessee father was arrested by an arrogant “student resource officer” what ever that is , for the “crime” of insisting on escorting his children home from school on foot . Apparently recently enacted school rules said that the children could either leave the school grounds unattended or be picked up by parents in their car , but only after waiting in a line that sometimes stretches a mile or more down the block and can take an hour to get through. 

    This dad simply wanted to escort his 8 to 14 year old children home from school on foot and for that he was arrested . Just who do our children belong to here ? Us or the State ? Now we see what Hillary means by “It Takes A Village To Raise Your Children” . We haven’t heard the end of this case . Stay tuned .

” A Tennessee father was arrested for disorderly conduct last week after objecting to an official school policy that apparently prohibited him from picking up his children on foot ahead of the majority of parents picking their children up in their cars.

The new student pick-up policy, which reportedly started last week, says that parents can only pick up their children after 2 p.m. by waiting in a line of cars until everyone is released at 2:35 p.m. In this particular case, the parent was walking, so it wouldn’t make much sense to wait in the line of cars.

As Jim Howe made his case to South Cumberland Elementary School Resource Officer Avery Aytes, the man’s fiancé recorded the entire exchange. In the roughly 6 minute discussion captured on video, Howe does not appear to seriously raise his voice or make any threatening gestures. It should be noted that there could be more to the video, however, the moment that Aytes arrests Howe appears to be shown in full context.”

Libertarians Win Historic Court Case Putting Partisan LP Tennessee Candidates On Ballot

 

 

 

 

” Represented by Oklahoma Libertarian attorney Jim Linger, the Tennessee Libertarian Party (LPTN) and state chair Jim Tomasik won their case for ballot access in federal court on Oct. 31.

The U.S. District Court for the Middle District of Tennessee ordered election officials to list Tomasik as a Libertarian on the ballot for the Nov. 21 special election for state house, rather than as an independent.

Federal Judge William J. Haynes had already ruled provisions of Tennessee’s ballot access law unconstitutional in February 2012 in response to a joint suit by the Green Party and Constitution Party, a decision that the state is appealing.

The law put Democratic and Republican candidates on the ballot automatically, while minor-party candidates were required to meet standards set so high that they were effectively forced to run as independents.

To gain state ballot access, third parties were required to submit roughly 40,000 signatures, all gathered by members of their own party and within tight deadlines. Tomasik maintains that even the majority parties would not be able to satisfy such prohibitive requirements.”

Prosecutor Asks That She Not Be Called ‘the Government’ Because The Term Is ‘Derogatory’

 

 

 

” Last month a Tennessee judge overseeing a burglary case rejected a pretrial motion in which the prosecution requested that it not be referred to as “the Government” because that term is “derogatory.” In the May 22 motion, Assistant District Attorney General Tammy J. Rettig noted with alarm that “it has become commonplace during trials for attorneys for defendants, and especially Mr. [Drew] Justice [the defendant’s lawyer], to refer to State’s attorneys as ‘the Government’ repeatedly during trial.” …  She therefore urged Williamson County Circuit Court Judge Michael Binkley to bar Justice from using the g-word during the trial and instead refer to her as “General Rettig, the Assit District Attorney General, Mrs. Rettig, or simply the State of Tennessee.”

In his response, Justice argued that such an order would violate the First Amendment. Should Judge Binkley nevertheless see fit to comply with Rettig’s request, Justice said, he also should consider a few other speech limits in the interest of neutral terminology:

First, the Defendant no longer wants to be called “the Defendant.” This rather archaic term of art, obviously has a fairly negative connotation. It unfairly demeans, and dehumanizes Mr. Donald Powell. The word “defendant” should be banned. At trial, Mr. Powell hereby demands be addressed only by his full name, preceded by the title “Mister.” Alternatively, he may be called simply “the Citizen Accused.” This latter title sounds more respectable than the criminal “Defendant.” The designation “That innocent man” would also be acceptable.

Moreover, defense counsel does not wish to be referred to as a “lawyer,” or a “defense attorney.” Those terms are substantially more prejudicial than probative….Rather, counsel for the Citizen Accused should be referred to primarily as the “Defender of the Innocent.” This title seems particularly appropriate, because every Citizen Accused is presumed innocent. Alternatively, counsel would also accept the designation “Guardian of the Realm.” Further, the Citizen Accused humbly requests an appropriate military title for his own representative, to match that of the opposing counsel. Whenever addressed by name, the name “Captain Justice” will be appropriate. While less impressive than “General,” still, the more humble term seems suitable. After all, the Captain represents only a Citizen Accused, whereas the General represents an entire State.”

Tennessee Cop Fired After Shooting, Pepper Spraying Squirrel

 

” Jody Putnam, a former police officer in Mountain City, Tenn., was fired after a violent run-in with an agitated squirrel.

Putnam arrived at Mountain City’s Dollar General when animal control was unavailable to respond to a call about a squirrel running amok in the store.

According to the city’s Tomahawk newspaper, Putnam tried to subdue the rodent with pepper spray. When that didn’t work, he pulled out his gun and shot the animal multiple times.

Property owner Carl Duffield offered a different version of the story, telling WJHL that Putnam fired his weapon multiple times inside the store.

“Shooting back there, of course that should not have been, that should not have happened,” Duffield said. Then Putnam pulled out his can of pepper spray — forcing customers out of the store.”

 

   The officer opens fire in the midst of a public venue and people wonder why he was fired ? The UPI article linked above claims that the officer was specifically called to deal the squirrel while the item below claims that the officer just happened to be in the store when the rodent entered and thus took it upon himself to blast the little creature to smithereens.

” Police documents have revealed that officer Jody Putnam was inside the store two weeks ago when a squirrel managed to wander inside. Employees were the first to spot the squirrel, but when Putnam saw the situation he decided to intervene. However, the methods he used have now cost him his job in the police force.

Putnam reportedly used extreme and excessive force to address the squirrel situation, allegedly discharging his firearm and shooting at the squirrel while inside the store.

However, unloading his gun did not appear to work, and so he turned to another close up weapon at his disposal – pepper spray. He allegedly started chasing the terrified squirrel around the store trying to discharge the pepper spray into its eyes. But again the squirrel was too quick for Putnam and he eventually gave up.”

 

     Even though there seems to be little doubt , whichever story strikes you , that the officer should have been fired , given that in both versions he seems to have shown exceedingly poor judgement in drawing and discharging his weapon repeatedly among a store full of innocent bystanders , the reality is that he was fired not for his stupidity but for his refusal to file the appropriate paperwork(report) about the incident .

 

 

 

 

 

 

 

 

Naked Wife Distracts Victim While Husband Burglarizes Home

 

 

 

” Police in Crossville are still searching for the woman who skinny dipped in a neighbor’s pool to distract him while her husband stole from the man’s home.

The incident occurred on the afternoon of June 27 at the victim’s home on Canterbury Lane in the Camelot subdivision in Crossville, about 100 miles east of Nashville.

The 54-year-old victim told police he was approached by the couple, who live nearby, and the 30-something-year-old woman asked if she could swim in his pool.”

 

 

 

 

 

 

Professor Orders Students To Support Gay Rights

” A Tennessee community college professor ordered her students to wear ribbons in support of gay rights and said those who supported the traditional definition of marriage are just “uneducated bigots” who “attack homosexuals with hate,” according to a legal firm representing several of the students in the class.

Students in a general psychology class at Columbia State Community College were directed by their professor to wear “Rainbow Coalition” ribbons for an entire day and express their support for the homosexual community, said Travis Barham, an attorney with the Alliance Defending Freedom.

Barham is calling for the college to punish Dr. Linda Brunton and order her to apologize to the students whose constitutional rights he believes were violated, according to a letter he sent to the community college president.”

A Defeat For The Muslim Brotherhood, A Model For Winning

 

 

” The Muslim Brotherhood was handed a tactical defeat on June 4, 2013 in Manchester, TN. The FBI and DOJ (Department of Justice) appeared at a meeting called by AMAC (American Muslim Advisory Council — Muslim Brotherhood) in Manchester, TN. It was to include a talk by a US Assistant Attorney General and an FBI agent in charge. The meeting was due to a joke posted by a Coffee County Commissioner on Face Book. The DOJ Assistant Attorney General Killian said in a newspaper interview that the joke might be in the category of a hate crime.

Over 1200 people came from all over the US to a meeting in a town of 10,000. The web had buzzed about free speech in Manchester and talk radio chimed in .

In the course of the presentation by Killian, several in the audience began to shout our retorts to him. At first some in audience tried to shush them, but the momentum began to build and the shouted challenges increased in numbers and volume. It should be noted that the shouts were factual and knowledgeable. An example: when it was mentioned how hard it was to be a Muslim refugee: “Free medical care, welfare and scholarships tough to take?” When Killian said that DOJ protected voter rights, the shouts were to the tune of: “You mean like protecting the Panthers in Philadelphia?”

When Killian mentioned Eric Holder, the room erupted with thunderous boos. People were angry about the Feds. The FBI agent presented a better face, but he got blow back as well. Chants of “Ruby Ridge” and “Waco” rang out. This was a “mad as hell and not going to take it anymore” attitude.”

America’s Self-Inflicted Death Of A Thousand Cuts

 

 

” It is clear that the Muslim community will try to implement Sharia Law in America incrementally, starting with the suppression of free speech.  They will do this by using intimidation and scare tactics.  The Muslims are inching ahead in the war on free speech using the tool of “political correctness” as their weapon of choice. What is most shocking is the following statement made by U.S. Attorney Killian in that same article: “Killian said Internet postings that violate civil rights are subject to federal jurisdiction. “That’s what everybody needs to understand,” he (Killian) said.”

This is clearly intimidation of our own free speech, supposedly protected under our First Amendment.  It is saying that Muslims will be protected unlike any other group and must be handled with kid gloves.  It is stifling the rights of American citizens to exercise their God given right to free speech.  Further, one wonders why this is being held in a small town in Tennessee.

With the recent opening of the Murfreesboro mosque and the massive influx of Muslim Somalian refugees to Tennessee, Shelbyville seems to be the model for the next Dearborn.”

 

 

 

 

 

 

 

 

 

 

 

Shots Fired At TVA Watts Bar Nuclear Plant

 

 

 

 

” A TVA spokesperson confirmed that a security officer patrolling TVA Watts Bar Nuclear Plant in Spring City was involved in a shootout with a suspect Sunday at about 2:00 a.m.

The security incident happened on the Tennessee River side of the plant property, more than a quarter mile from the plant’s protected area, which houses its reactor and power production facilities.

TVA spokesperson Jim Hopson said the subject traveled up to the plant on a boat and walked onto the property.  When the officer questioned the suspect, the individual fired multiple shots at the officer. The officer shot back, and when he called for backup, the suspect sped away on his boat. “
