IRS Watchdog Reveals Lois Lerner Missing Emails Now Subject Of Criminal Probe

 

 

 

 

 

 

 

” The IRS’s inspector general confirmed Thursday it is conducting a criminal investigation into how Lois G. Lerner’s emails disappeared, saying it took only two weeks for investigators to find hundreds of tapes the agency’s chief had told Congress were irretrievably destroyed.

  Investigators have already scoured 744 backup tapes and gleaned 32,774 unique emails, but just two weeks ago they found an additional 424 tapes that could contain even more Lerner emails, Deputy Inspector General Timothy P. Camus told the House Oversight Committee in a rare late-night hearing meant to look into the status of the investigation.

“There is potential criminal activity,” Mr. Camus said.”

Texas Republican Announces Challenge To Boehner For Speaker In New Congress

 

 

 

 

 

” Rep. Louis Gohmert (R-Texas) said Sunday that he will challenge John Boehner (R-Ohio) as Speaker in the new Congress.

“ I’m putting my name out there today to be another candidate for Speaker,” Gohmert said on “Fox and Friends.”

  Gohmert said that after “years of broken promises, it’s time for a change.”

  Rep. Ted Yoho (R-Fla.) on Saturday announced that he would not support Boehner for Speaker.

” This is not a personal attack against Mr. Boehner, however, the people desire and deserve a choice,” Yoho said in a Facebook post. “In November, they resoundingly rejected the status quo.”

“ Eventually, the goal is second, third, fourth round, we have enough people that say ‘you know what, it really is time for a change,’ ” Gohmert said Sunday. “’You deceived us when you went to Obama and Pelosi to get your votes for the cromnibus. Senator McCain’s Team Cleanses Local Government Of Hostile Conservatives

 

 

 

 

” Sen. John McCain‘s team is allegedly reshaping the local Republican government in Arizona by getting rid of hostile conservatives as he prepares for a likely 2016 reelection campaign.

  McCain’s goal is to seat friendly precinct committeemen to local offices, replacing conservative instigators and decreasing Tea Party influence, according to a report published by Politico.

  Precinct committeemen determine which candidates are promoted in an election year, what political issues are featured and how GOP state and local funds are spent.

  Before Aug. 26, the majority of the 3,925 precinct slots in Arizona were filled by people McCain’s team considered opponents, Politico reports. After the team’s strategy was implemented, about 40 percent of those offices, 1,531, are now considered friendly to McCain.”

IRS Warns Of Possible Shutdown

 

 

 

 

 

” The IRS is considering its own temporary shutdown due to recent budget cuts enacted by Congress, its chief said Thursday.

  IRS Commissioner John Koskinen said furloughs — forced unpaid days off for employees as part of an IRS closure — is one idea reluctantly being tossed about to save money, though they are hoping they will not have to go there.”

 

 

” “ People call it furloughs; I view it as: Are we going to have to shut the place down? And at this point, that will be the last thing we do, … but there is no way we can say right now that that wont happen,” Koskinen told reporters at a Thursday press conference on the upcoming tax season. “Again, I would stress that would be the last option.”

  He said a shutdown would mean the IRS would “close the agency for a day, two days, whatever days it would take to close the gap that we can’t otherwise close in a reasonable way.”

  The agency estimates each closed day would save $29 million. “

” A Long Island mother of three arrested for taking pictures of an Air National Guard base in the Hamptons ​– ​while ​armed to the teeth with a licensed assault rifle in her car — has been awarded ​$1.12 million​ by a federal jury over her false prosecution by Suffolk County authorities.

  ​The Central Islip ​jury ​on Thursday sided with Nancy Genovese, 58, in a 2010 lawsuit she filed against Suffolk County​, its​ Sheriff’s Office and other parties, ​claiming she was ​only ​arrested during the July 2009 incident because she belonged to the Tea Party.

  Genovese was arrested while taking pictures of a decorative helicopter in front of the Gabreski Airport Air National Guard base in Westhampton Beach for a “Support Our Troops” website. She was charged with criminal trespass and spent four days in jail before the charges were dropped.

  Southhampton cops searched her and found a legally owned rifle that she was transporting from a nearby rifle range. She contends a deputy sheriff arrived on the scene later and said to her, “I bet you are one of those Tea Party people.” When Genovese said she’s gone to Tea Party rallies, he allegedly said, “You’re a real right-winger, aren’t you?” and “You are a ‘Teabagger’” and then added that she’d be arrested for terrorism to make an example of other “right wingers.” “

Fox News Poll: 70 Percent Want Congress To Keep Probing IRS

 

 

 

 

” Call it a “kumbaya” question, as majorities of Democrats (60 percent), independents (75 percent) and Republicans (78 percent) support lawmakers continuing to dig. 

  The new poll also asked why the White House is refusing to release thousands of pages of documents related to the IRS targeting.  By nearly three-to-one people think it’s because the administration wants to keep its role in the scandal secret (63 percent) rather than to keep taxpayer information confidential (22 percent). 

  Even Democrats are more likely to say the Obama White House is withholding documents to hide its involvement (45 percent) rather than to protect taxpayers (35 percent).  Another 20 percent is unsure. 

  Many of the tax-exempt groups the IRS targeted for special scrutiny have “tea party” in their name.  For those who consider themselves part of that movement, 87 percent want the congressional investigation to continue, and another 91 percent feel the Obama administration is covering up its role by withholding documents.”

Lerner Met With DOJ Month Before 2010 Elections

 

 

 

 

” Judicial Watch, a constitutionally conservative, non-profit educational foundation, has new evidence against Lois Lerner in the IRS Tea Party targeting case.   
    
  Documents they’ve just obtained from the Department of Justice show that the former IRS official met with Department of Justice’s Election Crimes Division one month before the 2010 elections.
      
  The Justice Department has withheld more than 800 pages of documents in the Lerner investigation, citing “taxpayer privacy” and “deliberative privilege.”
   
These new documents dramatically show how the Justice Department is up to its neck in the IRS scandal and can’t be trusted to investigate crimes associated with the IRS abuses that targeted Obama’s critics. And it is of particular concern that the DOJ’s Public Integrity Section, which would ordinarily investigate the IRS abuses, is now implicated in the IRS crimes,” Judicial Watch President Tom Fitton said.

2,500 New Documents ID’d In White House-IRS Taxpayer Harassment Cases

 

 

” In a shocking revelation, the Treasury Inspector General has identified some 2,500 documents that “potentially” show taxpayer information held by the Internal Revenue Service being shared with President Obama’s White House.

  The discovery was revealed to the group Cause of Action, which has sued for access to any of the documents. It charges that the IRS and White House have harassed taxpayers.

  In an email from the Justice Department’s tax office, an official revealed the high number of documents, suggesting that the White House was hip deep in probes of taxpayers, likely including conservatives and Tea Party groups associated with the IRS scandal.

  In requesting a delay in the delivery date of the documents, Justice told Cause of Action, “The agency [Treasury Inspector General for Tax Administration] has located 2,500 potentially responsive documents and anticipates being able to finish processing 2,000 of these pages by the December 1 date. It needs the additional two weeks to deal with the last 500 pages to determine if they are responsive and make any necessary withholdings.”

House Committee Demands Answers On Truthy Project

 

 

 

 

 

 

” The House Science, Space, and Technology Committee sent a letter to the head of the National Science Foundation (NSF) on Monday, demanding answers about the origins of the nearly $1 million taxpayer-funded project to track “misinformation” on Twitter.

  The Truthy project, being conducted by researchers at Indiana University, is under investigation for targeting political commentary on Twitter. The project monitors “suspicious memes,” “false and misleading ideas,” and “hate speech,” with a goal of one day being able to automatically detect false rumors on the social media platform.

  The web service has been used to track tweets using hashtags such as #tcot (Top Conservatives on Twitter), and was successful in getting accounts associated with conservatives suspended, according to a 2012 book co-authored by the project’s lead researcher, Filippo Menczer, a professor of Informatics and Computer Science at Indiana University.

  Menczer has also said that Truthy monitored tweets using #p2 (Progressive 2.0), but did not discuss any examples of getting liberal accounts suspended in his book.

“ The Committee and taxpayers deserve to know how NSF decided to award a large grant for a project that proposed to develop standards for online political speech and to apply those standards through development of a website that targeted conservative political comments,” wrote Chairman Lamar Smith (R., Texas) in a letter to NSF Director France Cordova. 

“ While some have argued that Truthy could be used to better understand things like disaster communication or to assist law enforcement, instead it appears Truthy focused on examples of ‘false and misleading ideas, hate speech, and subversive propaganda’ communicated by conservative groups,” he said.”

Whistleblowers: IRS Officials Behind ‘Fraudulent’ Multi-Billion Dollar Corporate Tax Giveaways

 

 

 

 

” A 10-year veteran IRS attorney has demanded a Congressional audit of the IRS to investigate the agency’s alleged role in allowing American corporations to illegally avoid paying billions of dollars in taxes at the same time the agency is cracking down on individuals and small businesses.

  In a letter to Treasury Secretary Jacob Lew, IRS commissioner John A. Koskinen, and IRS chief counsel William Wilkins, Jane J. Kim, an attorney in the IRS Office of the Chief Counsel in New York, accused IRS executives of “deliberately” facilitating multi-billion dollar tax giveaways. The letter, dated October 19, will add further pressure on the agency, which is under fire for allegedly targeting conservative and Tea Party groups.

  Kim, who has previously blown the whistle on “gross waste of government resources” in the IRS New York field offices [Senior IRS Lawyer Charges Chief Counsel’s New York Office With Waste and Abuse], wrote in her new letter that senior IRS officials have “intentionally undermined the authority of the IRS Whistleblower Office” to avoid taking action “in cases involving billions in corporate taxes due.” The IRS also refuses to enforce laws for “large corporate taxpayers,” resulting in giveaways of further billions, despite applying the same laws with “draconian strictness to small business, the self-employed, and wage-earning individuals.”  … “

” Plaintiff Selim Zherka filed this … action claiming that employees of the Internal Revenue Service hindered his application for tax exempt status and initiated an investigation against him as part of a broader effort to penalize members of the Tea Party for their political activities….

  Beginning in 2009, plaintiff published newspaper articles and held rallies criticizing government officials for political corruption and “confiscatory tax policies.” Plaintiff organized and supported the creation of the Tea Party, a political party that received extensive publicity in the news media. At some point, plaintiff sought tax-exempt status for an organization he and others used primarily for educational purposes. However, plaintiff claims that defendant Lois Lerner …, an IRS employee, subjected his application to an inordinately high level of scrutiny, forcing him to abandon his efforts to obtain tax-exempt status. [The case against Lois Lerner was dismissed because “Plaintiff has not satisfied its burden of showing that [he] served defendant Lerner with a copy of the summons and complaint.” — EV]

  Plaintiff alleges that in 2011, agent Ryan of the Federal Bureau of Investigation … and agent Ashcroft … of the IRS began an investigation into his commercial real estate dealings. Plaintiff claims these defendants issued over 75 subpoenas to his business associates, threatening them with criminal prosecution should they withhold information incriminating plaintiff. Plaintiff alleges that as a result, many of these business associates terminated their relationship with him out of a fear of “running asunder of federal agencies.” He asserts that defendants’ conduct was part of a broader government strategy to penalize Tea Party members for their political speech.

New testimony from one of the IRS’ top lawyers released last night by the House Oversight Committee casts doubt on that story (via Instapundit):

  In testimony released Monday, Thomas Kane, the IRS’s deputy associate chief counsel, told House Oversight investigators last week that the agency was examining whether all the back-up tapes which held the emails have been recycled. “

Rep. Issa: Lerner ‘Broke Some Laws;’ Emails Show Her Attorney ‘Outright Lied A Number of Times’

” House Oversight and Government Reform Chairman Darrell Issa (R-Calif.) had a testy interview with Candy Crowley on CNN’s “State of the Union” yesterday, where he asserted that Lois Lerner “broke some laws” and “sent 1.1 million tax records” with illegal confidential information “on conservative groups” to the Department of Justice.

  Issa also claimed that Lerner’s attorney has “said things and been not correct, or disingenuous, or outright lied a number of times, and it’s been shown by e-mails.” 

  After pointing out that although Lois Lerner’s emails are missing due to her hard drive crash, 20,000 emails have been retrieved through other means, Candy Crowley asked: “Did Lois Lerner crash her own computer?”

” We will probably never know that – the drive is physically gone,” Issa replied. “

Trey Gowdy’s Not Having It: IRS Head Gets Cute About ‘Lost’ Emails & Has the Grin Wiped Off His Face

 

 

 

 

 

” During a rare Monday night hearing, House Republicans hammered embattled IRS commissioner John Koskinen over the “lost” Lois Lerner emails and over his continued insistence that there was no criminal wrongdoing in their coincidental disappearance.

  While, as to be expected, Rep. Trey Gowdy (R-SC) repeatedly challenged Koskinen, for instance, when he demanded that he cite a particular statute or statutes (law, viz.) on which to base his claim that no criminal wrongdoing occurred. When the commissioner replied, “you can rely on common sense,” Gowdy went off:

“ Common sense? Instead of a criminal code, you wanna rely on common sense? You can shake your head all you want to commissioner; you have said today that there’s no evidence of criminal wrongdoing and I’m asking you what criminal statutes you have reviewed to reach that conclusion?”

  Koskinen finally conceded: “I have reviewed no criminal statutes.”

  Ironically, the commissioner also insisted that outdated technology was to blame and that it would cost the IRS $10-30 million to update its systems.

  In response, Rep. Scott DesJarlais (R-TN) reminded Koskinen that the IRS paid $89 million in bonuses last year, including $1 million to employees who owed back taxes. Not a good day for the defiant commissioner of the IRS.”

 

 

     John Koskinen is the epitome of the smug , arrogant , elitist bureaucrat . It is a pleasure to see him squirm under the wrathful ire of Rep Gowdy even though there seems to be no new info forthcoming from any of these hearings .

” Is that a smoking gun  I smell?  It turns out the IRS contracted with a company that provides email backup services starting in 2005.  This first came to light in the Twitter feed of moregenr, who noticed that the IRS appears on the client list of email  archiving service provider Sonasoft.

  The IRS had a contract with email backup service vendor Sonasoft starting in 2005, according to FedSpending.org, which lists the contract as being for “automatic data processing services.” Sonasoft’s motto is “email archiving done right,” and the company lists the IRS as a customer.

  In 2009, Sonasoft even sent out a Tweet advertising its work for the IRS. “

  The IRS recently informed Ways and Means chairman Dave Camp and subcommittee chairman Charles Boustany that computer crashes resulted in additional lost e-mails, including from Nikole Flax, the chief of staff to former IRS commissioner Steven Miller, who was fired in the wake of the targeting scandal.

  The revelation about Lerner’s e-mails rekindled the targeting scandal and today’s news has further inflamed Republicans. Camp and Boustany are now demanding a special prosecutor to investigate “every angle” of the events that led to Lois Lerner’s revelation in May 2013 that the agency had used inappropriate criteria to review the applications for tax exemption.

  The lawmakers expressed particular outrage that the agency has known since February that it would not be able to produce the e-mails requested by the committee yet did not apprise the committee of that fact, and they charged in a statement that the IRS is attempting to “cover up the fact that it convenient lost key documents in the investigation.” “

” Who knew that the Obama administration had a penchant for black humor? Earlier this year, in February, President Obama told Bill O’Reilly during an interview on Fox News that there was “not even a smidgen of corruption” in the IRS scandal involving the targeting of conservative nonprofit groups. In July 2013, Treasury Secretary Jack Lew foreshadowed his boss’s nonchalance by insisting that there was “no evidence” that any political appointee had been involved in the scandal.

  Now we may know why. After months of delay in responding to congressional inquiries, the IRS now claims that, for the period of January 2009 to April 2011, all e-mails between Lois Lerner — the IRS official at the center of the scandal — and anyone outside the IRS were wiped out by a “computer crash.” As House Ways and Means chairman Dave Camp wrote in a statement, this loss means that “we are conveniently left to believe that Lois Lerner acted alone.” After all, there isn’t a “smidgen” of e-mail evidence to suggest otherwise.”

Norman Cillo, a former program manager at Microsoft, told The Blaze: “I don’t know of any e-mail administrator [who] doesn’t have at least three ways of getting that mail back. It’s either on the disks or it’s on a TAPE backup someplace on an archive server.” Bruce Webster, an IT expert with 30 years of experience consulting with dozens of private companies, seconds this opinion: “It would take a catastrophic mechanical failure for Lerner’s drive to suffer actual physical damage, but in any case, the FBI should be able to recover something.
