Pew First: Gun Rights Top Gun Control In Major Public Opinion Shift

 

 

 

 

 

” Exactly two years after President Obama’s bid for gun control following the Sandy Hook Elementary School shooting died in Congress, a new poll has discovered a huge shift in public opinion to backing Second Amendment gun rights and away from controlling gun ownership.

  The reason: Americans now believe having a gun is the best way to protect against crime, 63 percent to 30 percent.

  Pew Research Center found that while support for gun control once reached 66 percent, it has dropped to 46 percent while support for gun rights has jumped 52 percent, the highest ever in the past 25 years.

” We are at a moment when most Americans believe crime rates are rising and when most believe gun ownership – not gun control – makes people safer,” said the survey.”

Bill Would Allow Concealed Weapons Across State Lines

 

 

 

 

 

” Gun owners would be allowed to carry concealed weapons around the country under new legislation introduced in the Senate.

  The Constitutional Concealed Carry Reciprocity Act would allow gun owners who have a concealed carry permit in their home state to bring their firearms in any other state with concealed-carry laws.

” This operates more or less like a driver’s license,” Sen. John Cornyn (Texas), the second-ranking Republican in the upper chamber, told The Hill. “So, for example, if you have a driver’s license in Texas, you can drive in New York, in Utah and other places, subject to the laws of those states.” 

  Cornyn, a Texas Republican, said this would “eliminate some of the ‘gotcha moments,’ where people inadvertently cross state lines” with guns they are legally allowed to carry in their home state.

  The National Rifle Association endorsed the bill Thursday, calling it a “much-needed solution to a real problem for gun owners.” “

  When Sam Andrews awoke on Tuesday morning, he found his wife watching a television interview with a woman whose bakery had been vandalized during the violent unrest here on Monday.

“ She said, ‘You’ve got to go help her,’ ” Mr. Andrews said in an interview on Saturday morning.

  And so Mr. Andrews, a former Defense Department contractor who is now a weapons engineer in the St. Louis area, set to work. Under the auspices of a national group called the Oath Keepers, Mr. Andrews accelerated plans to recruit and organize private security details for businesses in Ferguson, which are receiving the services for free. The volunteers, who are sometimes described as a citizen militia — but do not call themselves that — have taken up armed positions on rooftops here on recent nights.

” The Maricopa County Attorney’s Office has agreed not to pursue criminal charges against a man who carried an AR-15 rifle into Phoenix Sky Harbor International Airport in July as long as he meets certain requirements, records show.

  Peter Steinmetz, a director at the Barrow Neurological Institute in Phoenix, had been facing two counts of disorderly conduct. After signing a “pre-indictment resolution offer” on Tuesday, Steinmetz told KPNX-TV that the deal was a victory for gun-rights advocates.

” I certainly didn’t intend to commit a crime; I did not commit a crime,” Steinmetz said. “I think the important point that was made is that, in fact, as Americans, we have a non-infringeable right to keep and bear arms and that you can legally do so at Sky Harbor Airport.”

Huge Win For Gun Rights In Alabama Election

 

 

 

 

 

 

” Alabama voters on Tuesday overwhelmingly favored a revision to the state constitution which will provide greater legal protections for the right to keep and bear arms. By a vote of 73 percent to 27 percent, voters amended the state constitution to include the following provision:

(a) Every citizen has a fundamental right to bear arms in defense of himself or herself and the state. Any restriction on this right shall be subject to strict scrutiny.

(b) No citizen shall be compelled by any international treaty or international law to take an action that prohibits, limits, or otherwise interferes with his or her fundamental right to keep and bear arms in defense of himself or herself and the state, if such treaty or law, or its adoption, violates the United States Constitution.

  Strict scrutiny is the most exacting level of judicial review employed by the courts. For a gun control law to survive strict scrutiny, the state must prove that it has a compelling interest that both justifies and necessitates the regulation in question. Among lawyers, strict scrutiny is frequently characterized as “strict in theory, fatal in fact.” Lawmakers receive no deference from the courts under this approach.

  Put differently, this new constitutional provision is a huge win for gun rights and a major defeat for gun control advocates in Alabama. “

Second Amendment Crushes Gun Control Candidates In Midterm Elections

 

 

 

” As the election returns came in on November 4 one thing was evident—the Second Amendment crushed gun control candidates in Senate and gubernatorial races around the country. 

  In so doing, the Second Amendment annihilated the left’s relentless claim that 90 percent of Americans support more gun control.

  On the gubernatorial level, in Arizona, pro-Second Amendment candidate Doug Ducey (R) beat gun control candidate Fred DuVaul (D). And in Florida, pro-Second Amendment incumbent Rick Scott (R) beat gun control candidate Charlie Crist. These victories were enhanced by the fact that Gabby Giffords and Mark Kelly endorsed DuVal and Giffords’ gun control PAC gave $100,000 to Crist’s campaign. 

  The Second Amendment trumped their endorsement and their money. 

  In Texas, NRA-endorsed gubernatorial candidate Greg Abbott (R) won. In Maryland, NRA-endorsed gubernatorial candidate Larry Hogan (R) won. In Alabama, NRA-endorsed Governor Robert J. Bentley (R) won. In Wisconsin, NRA-endorsed Governor Scott Walker (R) won. In Michigan, NRA-endorsed Governor Rick Snyder (R) won. In Nevada, NRA-endorsed Governor Brian Sandval (R) won. In Ohio, NRA-endorsed Governor John R. Kasich (R) won. In Oklahoma, NRA-endorsed Governor Mary Fallin (R) won. In Wyoming, NRA-endorsed Governor Matt Mead (R) won. In Idaho, NRA-endorsed Governor Bruce Otter (R) won. In Kansas, NRA-endorsed Governor Sam Brownback (R) won. And in Maine, NRA-endorsed Governor Paul R. LePage (R) won against gun control candidate Michael Michaud (D). (On August 8, Breitbart News reported that Michaud was supported by Gabby Giffords.)

  In Senate races, gun control Senator Mark Udall (D-CO) was defeated by NRA-endorsed Cory Gardner (R) and gun control Senator Kay Hagan (D-NC) was defeated by NRA-endorsed Thom Tillis (R). In Kansas, NRA-endorsed Senator Pat Roberts (R) won. In Georgia, NRA-endorsed Senatorial candidate Bill Perdue (R) won. In Arkansas, NRA-endorsed Tom Cotton (R) won. And in West Virginia, NRA-endorsed Shelly Moore Capito (R) won, marking the first time that state has sent a Republican Senator to Washington DC in over five decades. 

  The spotlight was also on the race between NRA-endorsed Senate Minority Leader Mitch McConnell (R-KY) and pro-gun control challenger Alison Grimes (D). McConnell won handily. 

  NRA-endorsed Senatorial candidate Joni Ernst (R-IA) also won. 

  On November 3—the day before the elections took place—Breitbart News reminded red state and pro-Second Amendment voters to vote like their guns depended on it. They did. And as result, the Second Amendment won the day, Republicans won the Senate, and gun control took a beating. “

  One problem: As of Wednesday, the day before a court-ordered deadline for the permitting process to begin, no instructors had been approved to teach the compulsory course.

  The disparity is emblematic of the city’s reluctant scramble to comply with the July order that overturned the District’s ban on carrying handguns in public.

  The Metropolitan Police Department, working off legislation adopted by D.C. lawmakers last month, released the concealed carry applications on its website at about 7 p.m. Wednesday — hours before the stay of U.S. District Court Judge Frederick J. Scullin Jr.’s order was set to expire.

  The regulations firm up the details of the application process, including establishing a $75 cost to apply for a permit.

  But it’s unlikely anyone will be walking out of police headquarters with the license anytime soon.”

Anti-Gun Movement Runs Out Of Steam In 2014

 

 

 

 

 

” For gun policy watchers in 2014, the game has become a one-sided affair. Gun rights advocates continue to rack up political and legal victories, while the anti-gun movement “seems to have run out of steam entirely” says John Pierce, co-founder of OpenCarry.org, and a Virginia gun rights attorney specializing in ‘gun trusts’ and the restoration of gun rights under Virginia and federal law.

  2014 looked promising for gun rights from the ‘get-go’ when in February the Federal Ninth Circuit held that the Second Amendment does not permit states to require citizens to justify their need to carry guns. The Court struck down California’s “may issue” carry permit scheme, generally following the precedent set by the Seventh Circuit when it struck down the Illinois ban on carrying handguns in 2012.

  July 1st then brought clarity to open carry in Kansas when a law took effect to clearly preempt localities from banning open carry.

  And then on July 29th, Federal District Judge Frederick J. Sculin Jr. struck down the District of Columbia’s ban on carrying handguns in public. For several days thereafter, citizens legally carried handguns about the District without causing alarm or crime. Judge Sculin later stayed his ruling to allow the District time to enact a reasonable scheme of gun carry regulations. The District’s response so far has been to draft a draconian may-issue permitting scheme like the one struck down by the Ninth Circuit early this year, and, adding insult to injury, ban gun carriers access to public transportation, not even allowing gun owners to sit in the back of the bus.”

Louisiana Restaurant Offers Heat-Packing Incentive: Way To Weed Out Gun-Grabbers!

 

 

 

 

 

 

” While a number of businesses are welcoming customers carrying firearms, a Louisiana restaurant has taken it a step further – offering an incentive to gun-toting diners.

  Bergeron’s Restaurant, located in Port Allen, is offering a 10 percent discount to any patron packing heat, according to local affiliate NBC33.

“ I just need to see a weapon,” owner Kevin Cox said. “I need you to be carrying a gun.”

  Cox first only offered law enforcement officers the discount, but other gun-toting customers wanted similar consideration, NBC33 reported.

Cox said he was only too happy to oblige.

“As long as everybody has a gun, we’re all the same size,” he told NBC33. “

” MSNBC just discovered that even their viewers are strong supporters of the Second Amendment and the right of honest citizens to carry guns in public.

  Directed by the networks hosts to an online poll about gun rights, the results overwhelming support the right to carry.

The question was: Should Kroger Shoppers be allowed to carry handguns?

  With more than 25,000 votes so far, 83 percent answered “Yes, it is a Constitutional Right and only 17 percent responded “No, it is a threat to public safety.”

Seven Months Later, Orange County Concealed Carry Permits Have Doubled

 

 

 

 

 

 

” Last February, the Ninth Circuit Court Of Appeals, which has jurisdiction over most of the Western United States, ruled that California’s concealed carry law was unconstitutional. The provision in the law stating that one must give “good cause” for a concealed carry permit was deemed too burdensome–and they’re right!

  After the ruling, Orange County saw a spike in concealed carry permits. It got to the point where the county had to spend an additional $1.6 million–and hire 14 part-time staffers–to process all the applications.

  At the time, Orange County Sheriff Sandra Hutchens said she wasn’t going to add more scrutiny to the concealed carry permit process. If you’re a law-abiding citizen and apply, you’ll get your permit. “

Federal Judge Rules DC Ban On Handguns Unconstitutional

 

 

 

 

” A federal judge on Saturday overturned Washington D.C.’s ban on carrying handguns outside the home, saying it was unconstitutional.

There is no longer any basis on which this Court can conclude that the District of Columbia’s total ban on the public carrying of ready-to-use handguns outside the home is constitutional under any level of scrutiny,” Judge Frederick Scullin said in an opinion.

” Therefore, the Court finds that the District of Columbia’s complete ban on the carrying of handguns in public is unconstitutional,” he added in his 19-page ruling.

  The court ordered the city to allow residents to carry handguns outside their homes and to let non-residents carry them as well.”

” INDIANAPOLIS — Former Alaska Gov. Sarah Palin fired up a crowd of thousands inside Lucas Oil Stadium Saturday night to kick off the National Rifle Association’s “Stand and Fight Rally,” saying Americans’ constitutional rights as envisioned by the founding fathers are under attack and policies like gun-free zones constitute “stupid on steroids.”

” They knew that if the Second Amendment goes, the rest of the constitution is not far behind,” she said of the country’s founders.

  In her approximately 12-minute address, Mrs. Palin also derided what she argued is akin to a ‘blame the messenger’ attitude on gun violence many Americans take today.

” Gun stores are an accomplice to crime,” she said, “and that fork made me fat.”

  Mrs. Palin, plucked from relative political obscurity to be the 2008 GOP vice presidential nominee, still enjoys significant support among elements of the party’s base, and was at times received like a rock star inside the complex adjacent to the Indiana Convention Center, where much of the gun rights group’s annual meeting has taken place.

  After 2008, she returned to Alaska and soon after quit her job, citing “frivolous” ethics probes and the associated legal costs. Her latest venture is a new show, “Amazing America,” on the Sportsman Channel.

  A handful of potential 2016 GOP presidential contenders spoke or appeared in videotaped messages that aired Friday at the conference.

  In addition to haranguing former New York City Mayor Michael I. Bloomberg’s gun control push and lampooning Attorney General Eric H. Holder Jr.’s recent testimony on Capitol Hill, she also tsk-tsked Vice President Joseph R. Biden Jr.’s suggestion last year to fire off shotgun blasts into the air to scare off would-be intruders.

” Just aim up in the air – that was his directive, his advice,” she said. “Well, fine, Joe Squirt Gun, if your rapist is a bird.”

  She also derided those who she said place an emphasis on political correctness in handling the country’s adversaries “instead of putting the fear of God in our enemies.”

  She said later in her address that if “I were in charge” — a line that drew applause from the crowd — “they would know that waterboarding is how we baptize terrorists.”

” Conservative firebrand Rep. Steve Stockman (R-Texas) on Wednesday touted his bill to dock federal funding to states with gun registries, amid controversy over New York’s newly passed gun control law.

” In states like New York, gun grabbing politicians are using gun owner registries to hunt down law-abiding gun owners and demand they surrender their personal firearms,” Stockman said. “My bill ends anti-gun tyranny by cutting off the funds gun grabbers use to implement their tracking and confiscation schemes.

  Stockman’s legislation, introduced earlier this month, would withhold National Instant Criminal Background Check System (NICS) or Community Oriented Policing Services Program funding to states that maintain gun registries or confiscate guns from people who are not legally allowed to own firearms.”

New York Gun Owners Face ‘SAFE Act’ Registration Deadline

New York gun owners who possess firearms classified as assault weapons under a new state law have until the end of Tuesday to register their guns — or face potential criminal charges.

  The requirement is part of a provision of New York’s so-called SAFE Act, the package of tighter gun restrictions signed into law  in Albany months after the Sandy Hook school massacre. The law broadened the state’s “assault weapons” ban to cover more kinds of semiautomatic weapons.

  Gun owners who lawfully possessed guns that are now on the banned list were allowed to keep their weapons, but had to register them with the state police. They were also given the option of selling their guns to a licensed New York dealer or out-of-state buyer by Jan. 15 of this year.

  Those who fail to comply could face a misdemeanor charge or — if they were already disqualified from owning a gun because of a prior criminal conviction or other reason — a potential felony.

  Some gun owners say they have no intention of obeying the edict, reports the Daily Gazette of Schenectady:

  Fulton County Sheriff Thomas Lorey said he has attended pro-gun rallies in the Capital Region over the past year at which thousands of people from across the state said they do not plan to register their assault weapons.

“ So many people have said they won’t register their guns. I haven’t been told personally, but I’m sure there are some people who have not registered in Fulton County and some who have,” Lorey said. “But I think everyone who plans to register their weapons has already done so.”

 

   Do not expect huge lines at your local State trooper barracks , as Sheriff Lorey says , whoever is going to register has most likely already done so , and we’ll wage it’s damn few .

March The Second Biggest Month For NICS Background Checks

” March was the third biggest month for firearm background check numbers in the National Instant Criminal Background Check systems history, according to numbers release by the FBI. That number changes when data is adjusted, Guns.com reports.

  According to the data, across the country 2,488,842 total background checks were performed  in March 2014, which is up by about 200,000 from one year ago and by about 400,000 from February.

  Additionally, March 2014 had three of the 10 highest number of checks in a single day, and the first two weeks of the month ranked in the top 10 for highest weeks for gun background checks. “

However, if the raw number is adjusted by subtracting out NICS purpose code permit checks used by several states such as Connecticut, Illinois and Utah for CCW permit application checks as well as checks on active CCW permit databases, it actually becomes the second highest March in NICS history, according to the National Shooting Sports Foundation, the industry’s lobby. […] “
