James Boyd Shooting: Two Albuquerque Cops Charged With Murder Of Homeless Man

 

 

 

 

 

 

” Two Albuquerque police officers have been charged with murder in the shooting death of James Boyd, a homeless man killed during a standoff in March. The Albuquerque District Attorney’s Office filed one count of murder each against SWAT team member Dominique Perez and former detective Keith Sandy on Monday.

  The Associated Press reported (via Yahoo News) Jan. 12 that Albuquerque D. A. Kari Brandenburg says she will take the case straight to a judge for preliminary hearing and by-pass the usual Grand Jury process. Brandenburg says she wants the hearing to be open to the public.

” Unlike Ferguson and unlike in New York City, we’re going to know. The public is going to have that information,” District Attorney Kari Brandenburg said. She was referring, of course, to the recent high-profile cases of Michael Brown and Eric Garner, both cases where men were killed by police officers and where both officers were eventually left not indicted by grand juries in their particular cases.

  At the same time, neither of the two men accused of shooting and killing James Boyd, have been arrested. Sam Bregman, a lawyer representing Keith Sandy, said, “I’m looking forward … to the DA’s office presenting one single witness that says this is murder.”

  However, the most damning evidence against the Sandy and Perez may be a video taken of the incident — from a police officer’s helmet camera — which shows a knife-wielding man known by Albuquerque police to be mentally ill (due to several run-ins with the suspect in the past) in a stand-off with several policemen in the Sandia Mountains. James Boyd, the man holding the upper ground and the knife, is being approached by several law enforcement members, all with their handguns drawn and pointed at Boyd. Although a defense attorney would later characterize Boyd’s actions as dangerous to the approaching officers, most viewing the viral video saw it as use of excessive force and outright murder, because Boyd had verbally agreed to surrender and had even gathered a few things when stepped toward the police officers and was shot by bean bags, tasers, and six live rounds.”

 

 

    Let’s hope that there can be some small measure of justice served for Mr Boyd . Albuquerque Security Forces Use Tear Gas On Raging Protesters After Fatal Police Shooting

 

 

 

 

 

” Albuquerque police have violently cracked down on protesters, using tear gas and arresting several demonstrators, after over nine hours of unrest. Hundreds expressed their anger over last week’s police shooting that saw a homeless man killed.

  At the beginning of the rally, protesters asked police to take responsibility for their actions.

“ The police serve us, they do not kill us,” one protester told the local KRQE media outlet, while one of the demonstrators held a sign that read, “APD: Dressed To Kill.”

 

 

 

 

 

 

” Another activist, Alexander Siderits, 23, told AP he was participating because he was “fed up” with how police treat citizens.

” It has reached a boiling point, and people just can’t take it anymore,” he stressed.

  The protesters are angry at the Albuquerque police’s involvement in 37 shootings, 23 of them fatal, over the past four years. Many believe it is far too many for a city with around 550,000 inhabitants. The most recent case of a police shooting happened on March 16 when a homeless man was shot dead on the east side of Albuquerque. The incident was caught on video and the FBI has now opened an investigation into the man’s death.”

APD Chief: Threat Directed At Officer Justifies Foothills Shooting

 

 

” Video from an officer’s helmet camera raises many questions about an officer-involved shooting Sunday in the foothills.

  As the suspect appears to surrender, police move in and ultimately shoot James Boyd, 38, several times with assault rifles. 

  Boyd had agreed to end a three-hour standoff and walk down the hill. First, he tried to make sure police will keep their word. 

” Don’t change up the agreement. I’m going to try and walk now. Don’t try to harm me. If you keep your word, I can keep you safe,” says Boyd to officers. 

  Boyd’s hands are empty. He puts on his backpack. He reaches down to pick up a thermos, puts it in his right hand and grabs a blue bag in his left hand.

  Just as he takes his first step to walk down police set off a flash-bang grenade. It fills the area with smoke to distract Boyd as a K-9 rushes him.

  The question police refuse to answer Friday was why they fired the flash-bang, when Boyd had all of his belongings and started walking down the hill. As the situation escalates, Boyd reaches both hands into his pockets and pulls out what appears to be knives. “
