” The pressure to strike Syria is really heating up for President Obama (even if there now appears to be a way out), but it might not necessarily be legal to do so. Judge Andrew Napolitano reiterated as much to Shepard Smith on Tuesday, saying this time that if Obama strikes Syria, he could very well be declared a war criminal by the European Union.

Napolitano warned that if Obama proceeds anyway, the consequences could be particularly dire for him.

“The president runs the risk of being declared a war criminal by a magistrate in the EU…. If they indict him as a war criminal, an indictment for which there’s no statute of limitations, after he leaves the White House, he can’t go to Europe for fear of having to confront this.”

” When Thomas Jefferson wrote the Declaration of Independence, he used language that has become iconic. He wrote that we are endowed by our Creator with certain inalienable rights, and among them are life, liberty and the pursuit of happiness. Not only did he write those words, but the first Congress adopted them unanimously, and they are still the law of the land today. By acknowledging that our rights are inalienable, Jefferson’s words and the first federal statute recognize that our rights come from our humanity — from within us — and not from the government.

The government the Framers gave us was not one that had the power and ability to decide how much freedom each of us should have, but rather one in which we individually and then collectively decided how much power the government should have. That, of course, is also recognized in the Declaration, wherein Jefferson wrote that the government derives its powers from the consent of the governed.

” The president cannot lawfully order the killing of anyone, except according to the Constitution and federal law. Under the Constitution, he can only order killing using the military when the U.S. has been attacked or when an attack is so imminent that delay would cost innocent lives. He can also order killing using the military in pursuit of a declaration of war enacted by Congress.

Obama has argued that he can kill Americans whose deaths he believes will keep us all safer, without any due process whatsoever. No law authorizes that. His attorney general has argued that the president’s careful consideration of each target and the narrow use of deadly force are an adequate and constitutional substitute for due process. No court has ever approved that. And his national security adviser has argued that the use of drones is humane since they are “surgical” and only kill their targets. We know that is incorrect, as the folks who monitor all this say that 11 percent to 17 percent of the 2,300 drone-caused deaths have been those of innocent bystanders. “

  So it would seem , according to legal minds better than ours that in order to invoke executive privilege Obama would have to admit that he had knowledge of ” Fast & Furious ” . We wonder what our resident “constitutional law ” president is planning . 

” This morning, the White House asserted executive privilege over documents related to Operation ‘Fast and Furious,’ perAttorney General Eric Holder’s request. Following this move,Judge Napolitano warned that we may be on the “precipice of a constitutional confrontation between the executive branch, the White House, and the Congress.”

Executive privilege, in its definition, provides protection over communications with the president himself, according to the judge. The letter sent by Eric Holder requesting executive privilege does not detail a discussion with the president, but Judge Napolitano said, “The implication is there.” “
