” When President Obama rewrote inconvenient parts of his very own Obamacare law, he undermined more than health care. The attitude of “we can do what we want” trickles down to the lowliest federal agencies. That’s what several federal judges are saying about the schemes of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

  The ATF is the Rodney Dangerfield of law enforcement; among its peers it “don’t get no respect.” So the agency devises creative ways of proving itself, if only to itself. For example, ATF agents posing as cocaine couriers in poverty-stricken neighborhoods of Los Angeles boasted of big plans to steal the narcotics they were supposed to deliver. They did this to goad “small-time crooks” into joining a high stakes fake “stash house” raid to obtain fake cocaine. The hoods would then be arrested.

  Agents are allowed to infiltrate a criminal enterprise, but this sting constituted what a federal judge called an outrageous fishing expedition. “In these stash-house cases,” said U.S. District Judge Otis D. Wright II, “the Government’s ‘participation in the offense conduct’ is what makes them particularly repugnant to the Constitution. Everything about the scheme — and therefore almost everything bearing upon a defendant’s ultimate sentence — hinges solely on the Government’s whim.”

  Threatened with stiff drug penalties, few perps challenge the charges, and federal prosecutors add easy convictions to their trophies. No drugs were taken off the street. “That’s the problem with creating crime,” observed Judge Wright, “the Government is not making the country any safer or reducing the actual flow of drugs.” The judge dismissed all charges against defendants, saying: “The time has come to remind the Executive Branch that the Constitution charges it with law enforcement — not crime creation.” “

ATF Agents Ignore Restraining Order And Raid Ares Armor In California

” Ares Armor was raided by ATF agents despite a restraining order issued by a federal judge last week. The National City, California gun parts stores is owned by Dimitri Karras. The former Marine refused to turn his AR-15 lower receiver customer list over to the federal government as demanded. Karras, said Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) agents wanted to investigate his more than 5,000 California customers who purchased gun parts from his store. “

” ATF agents threatened to close Ares Armor down if Karras did not turn over his customer list. The customers reportedly purchased a specific 80 percent lower receiver used to build an AR-15 rifle. The lower receiver serves as the base of the semi-automatic rifle. The Department of Justice and the ATF contend that “plastic” lower receivers (polymer not 3-D printed parts) in question are not legal because they do not have a serial number. Some gun owners who have purchased the polymer AR-15 lower receiver maintain the semi-automatic gun part does contain identifying numbers.”

” During the Saturday ATF raid on Ares Armor, the agent converged upon the store in full tactical gear and confiscated the AR-lower receivers. Just prior to the raid, both plain clothes and undercover ATF agents allegedly questioning customers outside of the California gun store.”

ATF Raids ‘80% Complete Receiver’ Manufacturer, Looking For ‘Illegal Guns’

 

 

 

” The Bureau of Alcohol, Tobacco, Firearms and Explosives raided EP Armory, in Bakersfield, California Friday, along with owner Chris Cook’s home. Details at this point are still very thin, but Cook says that agents indicated that they are looking for “illegal guns.” From ABC 23 News:

The ATF was not able to provide information on the on-going investigation. Grahm Barlowe with the ATF declined to comment on why the store was targeted or exactly what agents were looking for.

Cook said agents told him they were looking for illegal firearms.

  EP Armory is known mostly for its innovative “80% complete” AR-15 receivers. Such receivers, by virtue of still needing some machining in order to serve as the foundation of a firearm, are, legally speaking, just an inert hunk of metal–or in this case, strong (Kevlar-reinforced) polymer. That means they can be legally sold to anyone, without background checks, without the necessity of a serial number, without a requirement for records–almost as if there were a Constitutional amendment stating that by the absolute law of the land, we the people have a right to arms–a right that shall not be infringed.”

 

 

   Obama’s ATF has unilaterally decided that legal gun parts which are not classified as guns and thus do not fall under their purview are indeed something that they should be able to regulate . In addition to the unsuccessful raid on EP Armory another California 80% receiver manufacturer Ares Armor has fallen into the ATF’s sights but has received filed a temporary restraining order to deny the ATF from Ares’ customer lists .

 

 

” Ares Armor, a California gun parts manufacturer, has filed a temporary restraining order against the Bureau of Alcohol, Tobacco, Firearms and Explosives for fears the federal agency could soon bust down its doors.

For almost two years, the ATF has asked Ares Armor to turn over its customer list, but the company’s owner, Dimitrios Karras, has thus far respected the privacy of his clientele and refused to comply.

“They said either give us these 5,000 names or we’re coming in and we’re pretty much taking everything, which is a huge, huge privacy concern and something we are not willing to do,” Karras told KSWB.”
