Federal Agencies Get Poor Marks On Sunshine Week Scorecards

FOIA Report Card

” Despite President Obama’s pledge to run the “most transparent administration in history,” federal agencies are still struggling to meet White House benchmarks, and at least three ignored Freedom of Information Act reporting requirements, according to several recent reports released in conjunction with Sunshine Week.

The government watchdog group Cause of Action released a Freedom of Information Act report card for 15 federal agencies that receive the bulk of all FOIA requests. Six of the 15 agencies received failing grades. Three agencies—the Departments of Education, Homeland Security and Treasury—earned “F” grades for failing to comply with the law’s annual reporting requirements.

“ Our oversight mission—which focuses on transparency, and accountability in the Federal government—depends upon agency compliance with FOIA,” Cause of Action executive director Dan Epstein said in a statement. “Based on our findings over the past three years, Cause of Action has no reason to believe that agency performance under FOIA has improved, which is simply unacceptable to taxpayers who deserve a government that operates in the open.”

Besides FOIA compliance, agencies are also lagging in other areas. An audit by the National Security Archive released Friday found that only 40 percent of agencies have followed laws requiring them to post records released through FOIA in their electronic reading rooms.”

2,500 New Documents ID’d In White House-IRS Taxpayer Harassment Cases

” In a shocking revelation, the Treasury Inspector General has identified some 2,500 documents that “potentially” show taxpayer information held by the Internal Revenue Service being shared with President Obama’s White House.

The discovery was revealed to the group Cause of Action, which has sued for access to any of the documents. It charges that the IRS and White House have harassed taxpayers.

In an email from the Justice Department’s tax office, an official revealed the high number of documents, suggesting that the White House was hip deep in probes of taxpayers, likely including conservatives and Tea Party groups associated with the IRS scandal.

In requesting a delay in the delivery date of the documents, Justice told Cause of Action, “The agency [Treasury Inspector General for Tax Administration] has located 2,500 potentially responsive documents and anticipates being able to finish processing 2,000 of these pages by the December 1 date. It needs the additional two weeks to deal with the last 500 pages to determine if they are responsive and make any necessary withholdings.”

New Complaint Alleges Harry Reid Intervened On Behalf Of Immigration Visa Scam To Benefit Son’s Client

Reid Ethics Complaint

” Senate Majority Leader Harry Reid is the target of an ethics and conflict-of-interest complaint over his involvement in a visa-investor venture.

The complaint, filed by the nonprofit activist group Cause of Action, asserts that Reid intervened with top immigration officials to benefit EB-5 visa seekers. The applicants were law clients of Reid’s son.

Among the officials contacted by Reid was Alejandro Mayorkas, then director of the U.S. Citizenship and Immigration Services.

“ Despite the fact that these applications were ineligible for appeal, Sen. Reid’s efforts to lobby USCIS resulted in the reconsideration and approval of these applications, as well as the subsequent securing of millions of dollars in foreign and domestic funds for the (Las Vegas) SLS Hotel & Casino and American Dream Fund EB-5 Regional Center — both of which are major contributors to the Democratic Party,” Cause of Action Executive Director Daniel Epstein wrote.”
