IRS Has Lost More E-mails . . .

 

 

 

 

 

 

” It’s not just Lois Lerner’s e-mails. The Internal Revenue Service says it can’t produce e-mails from six more employees involved in the targeting of conservative groups, according to two Republicans investigating the scandal.

  The IRS recently informed Ways and Means chairman Dave Camp and subcommittee chairman Charles Boustany that computer crashes resulted in additional lost e-mails, including from Nikole Flax, the chief of staff to former IRS commissioner Steven Miller, who was fired in the wake of the targeting scandal.

  The revelation about Lerner’s e-mails rekindled the targeting scandal and today’s news has further inflamed Republicans. Camp and Boustany are now demanding a special prosecutor to investigate “every angle” of the events that led to Lois Lerner’s revelation in May 2013 that the agency had used inappropriate criteria to review the applications for tax exemption.

  The lawmakers expressed particular outrage that the agency has known since February that it would not be able to produce the e-mails requested by the committee yet did not apprise the committee of that fact, and they charged in a statement that the IRS is attempting to “cover up the fact that it convenient lost key documents in the investigation.” “

IRS Off The Hook: No Criminal Charges Over Tea Party Targeting

 

 

” The FBI is not planning to file criminal charges involving the Internal Revenue Service’s extra scrutiny of the Tea Party and other conservative groups, the Wall Street Journal reported on Monday, citing law enforcement officials.

  The newspaper quoted officials as saying that investigators probing the IRS actions, which unleashed a political furor in Washington, did not uncover the type of political bias or “enemy hunting” that would constitute a criminal violation. The evidence showed a mismanaged agency enforcing rules it did not understand on applications for tax exemptions, the Journal reported.

  The case is still under investigation, but criminal charges were unlikely unless unexpected evidence emerged, officials familiar with the probe told the paper.

  A Justice Department spokesman declined to comment when queried by Reuters.”

These are quotes from the Internal Revenue Service officials who testified this week before the House and Senate. That is the authentic sound of stonewalling, and from the kind of people who run Washington in the modern age—smooth, highly credentialed and unaccountable. They’re surrounded by legal and employment protections, they know how to parse a careful response, they know how to blur the essential point of a question in a blizzard of unconnected factoids. They came across as people arrogant enough to target Americans for abuse and harassment and think they’d get away with it.

So what did we learn the past week, and what are the essentials to keep in mind?”

 

In December 2010 the FBI came to ask about a person who’d attended a King Street Patriots function. In January 2011 the FBI had more questions. The same month the IRS audited her business tax returns. In May 2011 the FBI called again for a general inquiry about King Street Patriots. In June 2011 Engelbrecht’s personal tax returns were audited and the FBI called again. In October 2011 a round of questions on True the Vote. In November 2011 another call from the FBI. The next month, more questions from the FBI. In February 2012 a third round of IRS questions on True the Vote. In February 2012 a first round of questions on King Street Patriots. The same month the Bureau of Alcohol, Tobacco and Firearms did an unscheduled audit of her business. (It had a license to make firearms but didn’t make them.) In July 2012 the Occupational Safety and Health Administration did an unscheduled audit. In November 2012 more IRS questions on True the Vote. In March 2013, more questions. In April 2013 a second ATF audit.

All this because she requested tax-exempt status for a local conservative group and for one that registers voters and tries to get dead people off the rolls. Her attorney, Cleta Mitchell, who provided the timeline above, told me: “These people, they are just regular Americans. They try to get dead people off the voter rolls, you would think that they are serial killers.”

WASHINGTON — President Barack Obama said Monday he will not tolerate political bias at the Internal Revenue Service and promised to get to the bottom of the agency’s admitted targeting of conservative groups.

Obama, in his first comments on the revelations of political targeting at the tax agency, said he learned about them from the initial news reports Friday. With a growing list of congressional panels saying they will investigate the matter, Obama said people are properly concerned.

“You don’t want the IRS ever being perceived to be biased and anything less than neutral in terms of how they operate,” Obama said at a news conference Friday with British Prime Minister David Cameron at the White House. He called the revelations of targeting “outrageous.”

“I’ve got no patience with it. I will not tolerate it, and we will make sure that we find out exactly what happened on this,” the president added.

On Friday, the IRS apologized for scrutinizing the tax-exempt status of groups with conservative titles such as “Tea Party” or “Patriot” in their applications. Republicans have challenged the tax agency’s claim that the practice was initiated by low-level workers.

“I just don’t buy that this was a couple of rogue IRS employees,” said Sen. Susan Collins, R-Maine. “After all, groups with `progressive’ in their names were not targeted similarly.”

If it were just a small number of employees, she said, “then you would think that the high-level IRS supervisors would have rushed to make this public, fired the employees involved, apologized to the American people and informed Congress. None of that happened in a timely way.”

The IRS said Friday that it was sorry for what it called the “inappropriate” targeting of the conservative groups during the 2012 election to see if they were violating their tax-exempt status. The agency said no high-level officials were aware.

But according to a draft of a watchdog’s report obtained Saturday by The Associated Press that seemingly contradicts public statements by the IRS commissioner, senior IRS officials knew agents were targeting tea party groups as early as 2011.

Sen. Max Baucus, D-Mont., said the Finance Committee that he chairs will investigate the matter, the first in the Democratic-controlled Senate to announce an investigation. In the GOP-controlled House, the Ways and Means Committee and the Oversight and Government Reform Committee, also are investigating.

The Treasury Department’s inspector general for tax administration is expected to release the results of its nearly yearlong investigation in the coming week.

Lois G. Lerner, who heads the IRS division that oversees tax-exempt organizations, said last week that the practice was initiated by low-level workers in Cincinnati and was not motivated by political bias.

But on June 29, 2011, Lerner learned at a meeting that groups were being targeted, according to the watchdog’s report. At the meeting, she was told that groups with “Tea Party,” “Patriot” or “9/12 Project” in their names were being flagged for additional and often burdensome scrutiny, the report says.

The 9/12 Project is a group started by conservative TV personality Glenn Beck.

Rep. Mike Rogers, R-Mich., said “the conclusion that the IRS came to is that they did have agents who were engaged in intimidation of political groups is as dangerous a problem” as the government can have.

He added, “This should send a chill up your spine. … I don’t know where it stops or who is involved.”

Congressional Republicans already are conducting several investigations and asked for more.

“This mea culpa is not an honest one,” said Rep. Darrell Issa, R-Calif.

Collins said the revelations about the nation’s tax agency only contribute to “the profound distrust that the American people have in government. It is absolutely chilling that the IRS was singling out conservative groups for extra review.”

The IRS’ Lerner said that about 300 groups were singled out for additional review, with about one-quarter scrutinized because they had “tea party” or “patriot” somewhere in their applications.

” A story in the Washington Post yesterday about the Internal Revenue Service’s Cincinnati office, which does most of the agency’s nonprofit auditing, clearly contradicted earlier reports that the agency’s targeting of Tea Party groups was the result of rogue agents.

The Post story anonymously quoted a staffer in Cincinnati as saying they only operate on directives from headquarters:

As could be expected, the folks in the determinations unit on Main Street have had trouble concentrating this week. Number crunchers, whose work is nonpolitical, don’t necessarily enjoy the spotlight, especially when the media and the public assume they’re engaged in partisan villainy.”

” The Internal Revenue Service has identified two “rogue” employees in the agency’s Cincinnati office as being principally responsible for “overly aggressive” handling of requests by conservative groups for tax-exempt status, a congressional source told CNN.

In a meeting on Capitol Hill, acting IRS Commissioner Steven Miller described the employees as being “off the reservation,” according to the source. It was not clear precisely what the alleged behavior involved.

Miller said the staffers have already been disciplined, according to another source familiar with Miller’s discussions with congressional investigators. The second source said Miller emphasized that the problem with IRS handling of tax-exempt status for tea party groups was not limited to these two employees.

The comments came as all 45 Senate Republicans sent the White House a letter that called for the administration to “comply with all requests related to congressional inquiries without any delay” involving the controversy.

The letter called the scandal “yet another completely inexcusable attempt to chill the speech of political opponents and those who would question their government, consistent with a broader pattern of intimidation by arms of your administration to silence political dissent.” “
